Walsingham Planning report concerning CAMSFC site development

The request was refused by Stockport Metropolitan Borough Council.

Dear Stockport Borough Council,

Please provide a copy of the report conducted at public expense by Walsingham Planning, concerning the proposed plans for the Cheadle+Marple Sixth Form College Hibbert Lane site.

I understand that the council have a copy of this report and appreciate that a portion of the report may have to be redacted for commercial reasons. However, the overwhelming public interest (witness the involvement of MPs, councillors, involvement of thousands of residents, press coverage and massive response to petitions) in the matter warrants the release of the majority of this public-funded report.

I am writing in response to your request for information below (ref 4673).

 

The response to your request has been prepared by the relevant Council
service and is as follows:

 

The Council is unable to release the document requested. This is because
the content of the information describes the College’s advisors’ planning
case which is based on their professional interpretation of local and
national planning policy.  This interpretation could have a direct
relationship with the commercial value of the College’s site.

 

On this basis the exception from disclosure at Regulation 12(5)(e)
Environmental Information Regulations 2004 applies because the withheld
information would adversely affect the confidentiality of commercial
information. Although this exception applies, information can only be
withheld if this is in the public interest i.e. it is in the interests of
the public as a whole that this information is not disclosed.

 

In this instance the public interest lies in withholding this element of
the information because there are circumstances where developers and/or
their agents wish to explore development options with local planning
authorities to maximise the commercial value of their client’s site, while
meeting the requirements of both local and national policies.  It is
important to developers and their agents generally to have confidence in
exploring their options in a confidential manner, without this becoming
publicly available.  On this basis, the information is exempt from
disclosure and will not be provided.
