Dear Llywodraethu@celf.cymru | Governance@arts.wales,

Thank you for your email this afternoon.

As you note above

"The Freedom of Information Act 2000 (FOIA) gives the public a right of access to recorded information held by public authorities. Recorded information includes printed documents, computer files, letters, emails, photographs, and sound or video recordings."

Question 4
Q4 relates directly to work from the public purse and is subject to the Equality Act 2010. If ACW re refusing to tell me how many English language speaking individuals are writers of the report, does this mean that WAARU is subject to FOI requests on this tender because it was publicly funded by ACW?

Question 8 Q9
I have rephrased the questions under Q8 in the following manners:

"8] Is it legal for ACW to publish an anonymous report?
8.1] Since ACW was founded, how many anonymous reports have been published to date?

Question 9

I have rephrased the questions under Q9 9.1-9.3. in the following questions:

9] Please provide any evidence and documentation from ACW about the recommendations in the WAAARU report.

9.4] On what date did Arts Council Wales receive the Widening Engagement document by WAARU?
9.5.] On what date was this formally received and acknowledged by ACW?
9.6] Please provide any documentation between WAARU and ACW about the date of this document's submission to the council.
9.7] Does ACW have to implement the recommendations from WAARU?
9.8] What % of these recommendations will be implemented by the end of the Financial Year 2021-2022?

Thank you for saying you "as stated in my earlier communication, in the spirit of openness and transparency we will consider and respond to all 50 questions."

Clarification on 7.1.

7.1. Has Arts Council Wales funded prior organisations without track records of funding?

You have written "Please clarify if your referencing to 'funded prior organisations' is referring to Arts Council awarding grants or contracting organisations to undertake work through procurement"

Thank you for flagging this. I am writing to clarify that funded prior organisations referring both to awarding grants and contracting organisations to undertake work through procurement . Here are some supplementary questions:

How many non-legally constituted organisations has ACW awarded to undertake work through procurement?
How many BAME-led non-legally constituted organisations has ACW awarded to undertake work through procurement?
How many white-led non-legally constituted organisations has ACW awarded to undertake work through procurement?

Clarification on 7.2.

"7.2. How much has ACW given to non-constituted organisations?

Please clarify if your referencing awarding grants or contracting organisations to undertake work through procurement and timeframe"

I am referencing both awarding grants and contracting organisations. For example, WAARU has no track record of funding, yet was awarded 50k, and I would like to know how this has happened.

Thank you for taking the time to respond to me.

Yours sincerely,

R Begum

Dear R Begum

Thank you for the your response.

With regards to your statement regarding Q4, this question in your original request does not ask how many English language speaking individuals are writers of the report. As per my earlier email, in the spirit of openness and transparency we will consider and respond to all 50 questions.

We will do this in accordance with the Freedom of Information Act where this may be applicable to the question being considered.

Thank you for the clarification you have supplied regarding your earlier revised questions, and I note the additional new questions you have now also submitted. These will be considered under Freedom of Information provisions and responded to within the statutory timescales of the Act.

Kind regards
Angela
