Voting and referendum including BREXIT at hospitals, prisons, police stations and courts

We're waiting for Spencer Gasson to read recent responses and update the status.

Dear Royal Borough of Windsor and Maidenhead,

Under the Freedom of Information Act, what arrangements are made to register people who may be in hospital (inc mental health) and prisons and when were these put in place? (Includes: http://www.legislation.gov.uk/ukpga/2005... )

How are people who are either in or out of the borough but in hospitals, prisons, held in a police station or at hospitals, prisons, police stations and courts able to cast their vote and exercise their democratic rights in line with legislation?

Does the council arrange to visit hospital (wards) and if so which hospitals and wards have been visited each time Windsor & Maidenhead votes since the 1997 general election? And how many votes were cast in each?

How has the council enabled people on Windsor & Maidenhead's electoral role to vote if they are out of the borough in hospital, prison, held in a police station or attending court?

How much do the Trusts and other bodies contribute to the costs of making sure the people they have a duty of care, to exercise their voting rights and maintaining their rights including confidentiality?

Is a member of electoral services staff or an independent scrutineer/volunteer available to assist and issue ballot papers in order to satisfy the Returning Officer that the votes have been cast in accordance with legislation requirements?

I am writing to respond to your information request. Your questions and
our answers are as follows:

 

Under the Freedom of Information Act, what arrangements are made to
register people who may be in hospital (inc mental health) and prisons and

A person who has been admitted as an in-patient in a mental health
hospital or another establishment maintained mainly for the reception and
treatment of persons with a mental health problem may be registered at the
hospital/establishment if the period they are likely to spend there is
sufficient for them to be regarded as resident there (Representation of
the People Act 1983, Section 7(2).

Patients in mental health hospitals who are convicted offenders and are
legally incapable of voting are not entitled to be registered.
(Representation of the People Act 1983, Section 3A) Convicted persons
detained in penal institutions are not entitled to be registered because
they are legally incapable of voting

 

How are people who are either in or out of the borough but in hospitals,
prisons, held in a police station or at hospitals, prisons, police
stations and courts able to cast their vote and exercise their democratic
rights in line with legislation?

No, the Electoral Registration Officer at RBWM does not visit hospitals in
the local authority area for the purposes of voter registration.

 

How has the council enabled people on Windsor & Maidenhead's electoral
role to vote if they are out of the borough in hospital, prison, held in a
police station or attending court?

 

The voting facility is in place according to law, but the Electoral
Registration Officer is not obliged to canvass hospitals or prisons for
the purposed of voter registration. 

 

How much do the Trusts and other bodies contribute to the costs of making
sure the people they have a duty of care, to exercise their voting rights
and maintaining their rights including confidentiality?

 

This information is not held by Electoral Services.

 

Is a member of electoral services staff or an independent
scrutineer/volunteer available to assist and issue ballot papers in order
to satisfy the Returning Officer that the votes have been cast in
accordance with legislation requirements?

 

Electoral Services staff are unable to assist electors with completing
ballot papers due to secrecy requirements in legislation.
