Voter Registration - 16-17 year olds in Secure Accommodation

Gwynedd Council did not have the information requested.

Section 19 of the Senedd and Elections Act 2020 allows for persons under 18 years of age to register to vote in Senedd Elections using a declaration of local connection. This includes those being kept in any secure accommodation specified in regulations made by the Welsh Ministers in circumstances specified in the regulations (see (2B) (b)).

In accordance with the Freedom of Information Act 2000 can you please provide me with the following information.

1. How many 16-17 year olds held in secure accommodation registered to vote in the 2021 Senedd Election.

I refer to your request under the Freedom of Information Act regarding the
number 16-17 year olds held in secure accommodation registered to vote in
the 2021 Senedd Election

 

The registration of electors is governed by the Representation of the
People Act 1983 as amended. Under Section 8 of the Act, the council must
appoint an officer of the council to be the registration officer for any
constituency or part of a constituency coterminous with or situated in the
council’s area.  The Chief Executive is the appointed officer for the
registration area of Gwynedd.  His appointment as Electoral Registration
Officer and Returning Officer is separate to his appointment as Chief
Executive and, although appointed by the council, the Electoral
Registration and Returning Officer’s responsibilities and duties are
personal. An example of this is that the register of electors is deemed to
be the property of the Electoral Registration Officer, not the local
authority.

As you will see, the Freedom of Information Act does not list any person
appointed under the Representation of the People Act 1983. It follows that
the Electoral Registration Officer, Returning Officer or any other person
appointed under the Act are not subject to the provisions of the Freedom
of Information Act.

 

Despite your request not being subject to the Freedom of Information Act
the matter was referred to the Electoral Services Unit who have confirmed
that the information requested is not held by them.
