Copies of the relevant CAR forms related to the above site visits are
attached in response to question 4.

 

We have also received one incident report on the 2 June 2014 reporting
that water had been discharging into a nearby watercourse in the Marton.. 
On investigation no discharge was seen.  The drilling taking place on the
West Newton site is to install a groundwater quality monitoring borehole. 
The Environment Agency has required groundwater monitoring boreholes to be
installed to the North and South of the site.  The boreholes are drilled
into the chalk geology and some groundwater from the chalk is coming to
the surface.  The water produced from the borehole will be groundwater
mixed with some chalk dust.  This will mix with rain water if it is
raining.  The groundwater boreholes have to be drilled outside the
contained site area so that the site HDPE liner is not punctured, and so
that the monitoring boreholes do not provide a potential pathway to the
groundwater.

Relevant exceptions

The exceptions that apply to this information are:

EIR regulation 13(1) which states “To the extent that the information
requested includes personal data of which the applicant is not the data
subject and as respects which either the first or second condition below
is satisfied, a public authority shall not disclose the personal data”.

 

The ‘first condition’ referred to above is further explained in Regulation
13(2)(a):

 

“…in a case where the information falls within any of paragraphs (a) to
(d) of the definition of “data” in section 1(1) of the Data Protection Act
1998, that the disclosure of the information to a member of the public
otherwise than under these Regulations would contravene —

i)             any of the data protection principles…”.

 

It is the view of the Environment Agency that the information requested
relates to another person, and that its disclosure would therefore
contravene the First Data Protection Principle of the Data Protection Act
1998.

 

The First Data Protection Principle requires that we are fair to
individuals when we collect, hold and use their personal data.  In this
case it would be unfair to disclose names or contact details as employees
have a reasonable expectation that this type of personal information would
remain confidential.

 

This exemption applies because the right given under the Regulations to
request official information held by public authorities does not apply to
the personal data of third parties where disclosure of that information
would not be fair to the individual, and where there is no legitimate
public interest in disclosure.

 

In all the circumstances of the case it has been determined that the duty
to the individual under the Data Protection Act 1998, and the public
interest in maintaining the exemption from disclosure of personal
information in this instance outweighs the public interest in disclosure.
