I can confirm that English Heritage holds information that falls within
the scope of your request and that, under the Environmental Information
Regulations (EIR) 2004, I am able to provide you with the following
information, as enclosed:

Re your request for visitor numbers for ‘each day for the years
2013,2014,2015 and 2016 ’, this information is not readily available.
Having looked in to this part of the request for you I am sorry to inform
you that I am unable to provide the information under Regulation 12(4)(b)
of the EIR: Manifestly unreasonable requests- contained within the EIR, as
I believe that the cost of compliance with your request is too great. 
12(4) For the purposes of paragraph (1)(a), a public authority may refuse
to disclose information to the extent that –

 

(b) the request for information is manifestly unreasonable:

 

As the application of all exceptions contained within the EIR are
qualified by a public interest test I must consider whether, in all the
circumstances of the case, the public interest in refusing this part of
the request on cost grounds outweighs the public interest in completing
it. It is important to note that any information released under the EIR is
in the public domain.

 

In favour of completing the request for daily numbers, I acknowledge that
it is in the public interest for the public to be provided with
information relating to English Heritage’s work. Making such information
public helps to ensure the transparency of our work. I have also
considered the presumption in favour of disclosure that is contained
within the EIR act.

 

In favour of maintaining the exception I have considered that the
information you have requested is only held by English Heritage and is
located in several parts of the databases and systems we use. It is not
possible to produce this degree of analysis you seek without substantial
manual manipulation of the data. In order to retrieve the information
requested, a member of staff would have to search the database/system/s
and extract the relevant data manually.

 

It is clear that this would not be straightforward to complete. Having
looked into this for you in some detail, I can confirm that locating and
extracting the information would take approximately an additional 3 days
of staff time. In assessing the cost that might be incurred in order to
respond to EIR requests, the Information Commissioner suggests that public
authorities use a rate of £25 per hour for any staff time involved. Using
this as a guide, I have calculated that it would cost English Heritage an
estimated £600 in staff time to respond to this part of the request.

 

Having considered the above I have concluded that the public interest is
currently best served by maintaining the exception that cost of compliance
for the data held is too great.

 

The burden created by answering the request would be significant, and
complying with the request would involve an unreasonable diversion of
resources from the provision of public services. Due to the time it would
take to complete this request, English Heritage's normal activities and
responsibilities would be interrupted. While English Heritage makes every
effort to operate in accordance with both the spirit and letter of the law
I would like to take this opportunity to make you aware of staff time that
requests such as your involve. Under the EIR Act organisations can refuse
requests because of this and I feel that this response provides you with
the information that I am able to within this limit.
