This FOI request has lapsed as the council was legally obliged to meet the request by 4th December. This refusal to acknowledge the delay and provide appropriate reason(s) means that I will now have to escalate this matter to the ICO for Wales. However, I am prepared to allow you until Tuesday 17th December to meet this request.

Dear Tina Delaney,

To clarify, the term 'breakdown' refers to the number of Violent Incident Report forms returned from different schools across the Local Authority recording violent incidents against staff (physical attacks or verbal abuse). So, how many were returned from each of the LA's secondary schools, how many from the LA's primary schools, and how many from the LA's Pupil referral units and special schools. It would be helpful to name each of the schools and the totals returned to the LA during the 5yr period requested or if this is too onerous, I will accept the total numbers per phase or type of school.

I note that you have taken an excessive length of time to raise this query, having responded way beyond the 20 working day limit with no justifiable reason. Therefore, a prompt response is now a matter of urgency.

I am following up on the FOI request I made on 5th November 2024. I am increasingly concerned by the council's lack of cooperation in relation to my request. Please note that we have now reached 53 working days since the request was made. This is both extremely frustrating and unjustifiable.

For the avoidance of doubt, Section 10 of FOIA sets out the timescales within which you must respond to a FOIA request. You must comply promptly, and no later than 20 working days following the date of receipt of the request. The Information Commissioner interprets this to mean that ‘day 1’ is the first working day after the request has been received.
The 20 working day timescale applies where a council has:
a duty under section 1(1)(a) to confirm or deny whether you hold the information;
a duty under section 1(1)(b) to provide information you hold to the requester;
a duty under section 17 to issue a refusal notice explaining why you have refused a request.

I note that Bridgend Council has not provided any reason(s) for their inability to meet this FOI request. This is unacceptable and is a demonstrable breach of the FOIA. Due to this ongoing delay and lack of communication I am now requesting that, as a matter of urgency, Bridgend Council now provides:

1. Its reasons for this non-compliance;
and,
2. The precise date when the FOI will be fully met.
