The Standards applied by Hertfordshire County Council for Secondary
Schools at the time of the Vincent & Gorbing Report (January 2011) were
consistent with DfES Building Bulletin 98- Briefing Framework for
Secondary Projects. This Client direction is noted on pages 4 of the
Report. The DfES BB98 Guidance does not cover employment related car
parking space, pupil drop off & collection related parking considerations,
vehicle circulation and site deliveries or site constraints such as
topography or trees. Additional land provision, as appropriate for each
site considered, is made for these items. This Client requirement is noted
on page 4 of the Report.
HCC car parking allocations policy can be found at the "Hertfordshire
Structure Plan Policy 25: Car Parking 2000 - 2011". These are as follows:

With specific regards to Team Games Space land allocation calculations,
the County Council's general approach was to consistent with Part V of
The Education (School Premises) Regulations 1999. This is not identical
to BB98 Guidance on Team Games Space.

These eight documents are now attached to this email.
Following careful consideration we have redacted cost information where
it appears in these documents as the Council considers that this falls
within the exemption contained in section 43(2) of the Freedom of
Information Act 2000 which relates to Commercial Interests. As this
exemption is a qualified exemption, in reaching its decision, the Council
has balanced the public interest test in withholding the information
against the public interest in disclosure.
The factors we have considered which are in favour of disclosure are:
· There is a public interest in allowing scrutiny of how public
money is spent and ensuring value for money when purchasing goods and
services.
· Facilitate the accountability and transparency of public
authorities for decisions taken by them including the procurement process;
· Allow individuals to understand decisions made by public
authorities affecting their lives and, in some cases, assist individuals
in challenging those decisions;
The factors we have considered which are against disclosure are:
· The information is commercial in nature
· The information is not in the public domain
· Disclosure would allow commercial rivals to have access to the
pricing mechanism of Vincent and Gorbing.
Balancing test – reasons why public interest favours withholding the
information:
On balance, we consider that the public interest does not favour
disclosing the requested information as it would be prejudice the
commercial interests of Vincent & Gorbing and inhibit our future working
relationship. Disclosure would allow Vibcent & Gorbing's commercial
rivals to understand their pricing mechanism and undercut them on any
future bids for contracts with the County Council or any other body. If
the County Council were to disclose such information it would constitiute
a breach of trust and would deter companies from tendering for County
Coouncil contracts in the future.

diaries for January 2010, and can find no indication that this meeting
took place.
To advise and assist you, the meeting of 26th April 2010 (attached) is the
first meeting which took place after the January meeting suggested in the
email, with the same attendees present.
In addition, the email in 'Secondary Schools SADC redacted.pdf' also
mentions that there is an attachment with the broad locations of 4 sites

provide this attachment please, as it appears to be informing the service

We try to follow ICO guidance in these matters but in this guidance there is a need to consider each instance on its own merits.
Our practice is to leave in all staff who report to an Assistant Director and above. These are counted as senior decision makers routinely.
Once we are below that level it will depend on the post affected.
The officer presenting a report to a council meeting may be recorded in that role as part of the decision making record (Cabinet or other minutes) that does not indicate that they are the decision maker.
Equally staff in some positions may have attended public meetings and may have been identified to those who were present on that occasion, however the ICO recognises that such events should be allowed to fade as they would from human memory. Staff change posts within the county council and when releasing information under FOI we accept that it may remain in the public domain permanently and therefore we will redact the names of staff who may be identifiable in the immediate event.
The County Council has a duty of care to its staff which is on-going. Our officers live in the communities of Hertfordshire and they have a right to a private life.

Dear Information Governance,
Thank you, your response does help to clarify the situation in regard to senior decision makers and helps me to know which officers names should be redacted. I appreciate that Officers below this level have a right to their privacy and live in and around Hertfordshire.
For those Officers that can be counted as Senior Decision makers in the period of time within which the request is in regard to. The trouble is in accountability and how that can be ensured, presumably this can be taken into account through the Officer's position within Hertfordshire County Council recorded in the documentation at the time?
In addition, for other third parties carrying out work for Hertfordshire County Council whose names are in the public domain can their names be unredacted in Freedom of Information Requests? Summary report dated January 2011, I request the brief that was provided
to Vincent and Gorbing by Hertfordshire County Council (and St Albans City

complete list of standards (and their exact specifications) used by HCC
staff to assess potential secondary school building sites.”
