Section 10(1) of the Freedom of Information Act 2000 states:

SEARCHES TO LOCATE INFORMATION

To locate the information relevant to your request searches were conducted
with our Digital Policing Department.  The searches located information
relevant to your request.

DECISION

This letter is to inform you that it will not be possible to respond to
your request within the cost threshold.  This response serves as a Refusal
Notice under Section 17 of the Freedom of Information Act 2000 (the Act).
 Please see the legal annex for further information on the exemptions
applied in respect of your request.

REASONS FOR DECISION

Body Worn Video's (BWV) are used in many different situations including
when officers are policing in relation to public protests.  This could be
for various reasons, some of which I have listed below:

* It may assist in providing a record of evidence in respect of the
investigation of any offence or suspected offence.
* When the use of BWV would provide transparency of an encounter (for
example stop and search, use of force).
* When users would have been expected or required to have completed a
written record or report of an encounter or incident.
* Any other occasion when the user thinks a recording may be of
evidential value in the future and to make a recording is
proportionate and lawful in the circumstances.

In your request you have asked for a copy of the video footage that was
taken during the Million Mask March.  I have been informed that in order
to obtain this information, firstly we would need to identify which
officers were involved in policing this event, then we would have to
obtain their BWV camera and download the data.  So for example, if an
officer were to complete an eight hour shift, it could take approximately
2-4 hours for the download of the data to be completed.  This estimation
does not take into account the fact that there could be several officers
trying to process their BWV footage at the same time, if this were the
case then the process would take longer.  As you can imagine the
deployment of officers was quite large, therefore in order to download all
the data in relation to this event would exceed the 18hrs provided under
the Act.

We therefore estimate that the cost of complying with this request would
exceed the appropriate limit. The appropriate limit has been specified in
regulations and for agencies outside central Government; this is set at
£450.00.   This represents the estimated cost of one person spending 18
hours [at a rate of £25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.

I would like to provide you with advice as to how you may narrow your
request so that it does not exceed the appropriate limit.

Any recordings from the BWV in question would contain images and audio of
third parties and would not be considered for disclosure  as personal data
can not be disclosed under the FoIA Act.  Therefore even if you were to
narrow this part of the request down, it would be likely that a Section 40
(2) would be applied in order to exempt the information from being
disclosed.

LEGAL ANNEX

Section 17(5) of the Act provides:

(5) A public authority which, in relation to any request for information,
is relying on a claim that section 12 or 14 applies must, within the time
for complying with section 1(1), give the applicant a notice stating that
fact.

Section 12(1)&(2) of the Act provides:

(1) Section 1 does not oblige a public authority to comply with a request
for information if the authority estimates that the cost of complying with
the request would exceed the appropriate limit.

(2) Subsection (1) does not exempt the public authority from its
obligation to comply with paragraph (a) of section 1(1) unless the
estimated cost of complying with that paragraph alone would exceed the
appropriate limit.

Section 16 of the Act provides:

(1) It shall be the duty of a public authority to provide advice and
assistance, so far as it would be reasonable to expect the authority to do
so, to persons who propose to make, or have made, requests for information
to it.

(2) Any public authority which, in relation to the provision of advice or
assistance in any case, conforms with the code of practice under section
45 is to be taken to comply with the duty imposed by subsection (1) in
relation to that case.
