If you need further details about the tender, we would have to consider
the exemption at Section 43 of the Freedom of Information Act (FoIA),
which relates to Commercial Interests.  Consequently, it would assist us
to process any such request, if you let us know in writing of any further
requirements.

 

Under the Freedom of Information Act, if you feel your request has not
been properly handled or you are otherwise dissatisfied with the outcome
of your request, you have the right to appeal. This would be to this
Office in the first instance. You can do this by e-mail or by post to the

Thank you for the Freedom of Information Request (FoIR) you recently sent
to the Office of the Kent Police & Crime Commissioner (OKPCC), and for the
clarification subsequently submitted.

 

Section 1 of the Freedom of Information Act (FoIA) places two duties on
public authorities:

 

·         Unless exemptions apply, the first duty at Section 1(1)(a) is to
confirm or deny whether the information specified in a request is held. 

·         The second duty at Section 1(1)(b) is to disclose information
that has been confirmed as being held. 

Section 17 of the FoIA requires that where exemptions are relied upon, we
provide the applicant with a notice which:

 

·         states that fact

·         specifies the exemption(s) in question and

·         states (if that would not otherwise be apparent) why the
exemption applies.

Section 10 of the FoIA sets out the time frames within which a public
authority must respond to a request.  If a public authority needs further
details, to ensure that the appropriate information is considered for
release, they should contact the requestor.  The 20 working day clock will
start the day after the authority receives the clarification.  That said,
we do endeavour at all times to respond to FoIR as soon as possible and I
am sorry for the length of time it has taken to reply on this occasion.

 

Please see your request below in bold, and the response provided within
the text of this e-mail and associated attachments.

 

If possible, I would be grateful to receive a copy of the successful
tender application from Victim Support and specific contract details,
including contract value as these are not available on the Bluelight
contracts register. 

 

The information you have requested is held.  I confirm that the annual
contract value is £950,000 and the tender application is contained in the
attached documents.

 

You will note some redaction within the documents provided.  This is by
virtue of Section 40 (2) in conjunction with Section 40(3) (a) (i) –
Personal Information.  Personal information is that which relates to a
living individual who can be identified from those specifics alone, or
when in conjunction with other details.   In this case, disclosure would
contravene the first data protection principle, because conditions of
Schedule 2 of the Data Protection Act 1998 are not met.  There is no
requirement to consider the public interest when invoking this
exemption.  

 

Additionally, details of the breakdown of costs are also exempt from
release by virtue of the exemption at Section 43 of the FoIA – Commercial
Interests.  Section 43 is a qualified exemption and subject to the public
interest test.  Based on this, we are satisfied that the release of this
information would prejudice commercial interests, and that the public
interest in withholding the information outweighs that of its disclosure. 

 

Under the FoIA, if you feel your request has not been properly handled or
you are otherwise dissatisfied with the outcome of your request, you have
the right to appeal. This would be to this Office in the first instance.
You can do this by e-mail or by post to the address at the foot of this
communication. We will then conduct an internal review to investigate the
matter and endeavour to reply within 20 working days.  

 

If you remain dissatisfied following this process and do not believe we
can help you any further, then you may wish to apply to the Information
