Dear Ministry of Justice,
This request is critical and is presented to you in protection of my Human Rights under Article 6 – Right to a fair trial and Article 8 – Right to respect for private and family life.
This freedom of information request is specifically for the Ministry of Justice Technology directorate and also to the Information Asset Owner (IAO) holding the data relating to all civil court proceedings.
A - Confirm that you have all the recorded information stored and managed in your secure data centre system managed by the MoJ Technology directorate for the case ref. no.: 3BT01335 allegedly issued by the County Court at Barnet.
B - Confirm that all the recorded information contained in the computerised court record for the County Court case ref. no.: 3BT01335 was directly transferred to the MoJ by the administration of the County Court at Barnet who recorded it on to Caseman system and it is now controlled by the MoJ Technology directorate.
C – Confirm that all the recorded information relevant to the County Court case ref. no.: 3BT01335 is in possession of the Information Asset Owner (IAO) as a member of the Operational Directorate and as part of all the data held, relating to all civil court proceedings.
D – Provide all the recorded information including the direct mailing address and contact details for the MoJ Technology directorate and also for the Information Asset Owner (IAO) dealing with all the data stored for County Court case ref. no.: 3BT01335 created by the County Court at Barnet.

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'Verification Of Court Records Required By The Ministry Of Justice'.
Consideredations:-
The case was not issued nor recorded by any court.
Hence:
1) The response did not come from the Ministry of Justice.
2) The exemptions Under sections 32(3) and 40(5) of the FOIA quoted have been used inappropriately in the response provided by HMCTS.
furthermore, there is no breach of any personal data that can be validly quoted for Questions 1, 2 and 3. The answers required for Questions 1, 2 and 3 do not require any personal data to be disclosed and so the answers would not be in breach the Data Protection Principles.
In relation to question 4 you can still provide the direct mailing address and contact details for the MoJ Technology directorate and also for the Information Asset Owner (IAO) dealing with all the data stored for County Court case ref. no.: 3BT01335 CREATED by the County Court at Barnet without breaching any personal data. It is reasonable that the contact details of public authorities and eventually public officers be made easily accessible to the public, in compliance with the HRA Article 5.
3) The exemptions quoted cannot be used because the Information is not held by any public authority.
4) The case ref. no.: 3BT01335 was never issued by the County Court at Barnet, nor any other court.
5) In any event, the requester's human rights quoted and presented supporting this request along with your common law duty to be open and transparent, required by the Ministry of Justice far exceed any possible and minor breach of the Data Protection Act. This is in the interest of justice against a serious corruption and organised crime.

as a Subject Access Request (SAR) for your personal information.

+ Proof of Identity
Proof of identity can be confirmed by providing a copy of a recent utility
bill and a copy of the photograph page of your passport or driving
licence. Please do not send originals.

Please provide an alternate contact address (e.g. a personal e-mail or

3. What Next?
