The department assisting with the response to your FOI request have asked
for clarification on question 5. 
 
Can you please advise us which timeframe you require for the spend on
marketing and advertising.  For example, are you interested in marketing
and advertising spend in the financial year 2013/14. 
 
I would be grateful if you could also clarify if you are interested in
marketing and advertising for a specific department of the Council or
whether you are seeking an authority wide response.  Can you also advise
us what level of detail you require for this as well please.

FREEDOM OF INFORMATION REQUEST X01-2796

 

We refer to your email dated 11 April 2014 which contained a request for
information as set out in italics below.  Following consideration of your
request, in accordance with the Freedom of Information Act 2000, I respond
to each point as follows:

 

 

1.            A list of vehicles owned or leased to the council. Please
include; registration mark, fleet number (if used), make & model and body
type.

Please see attached spreadsheets.  Whilst the Authority holds the
information requested in respect of the vehicle registrations we consider
that this is exempt under section 31 of the Freedom of Information Act
2000 which states that:

 

31 Law enforcement

(1) Information which is not exempt information by virtue of section 30 is
exempt information if its disclosure under this Act would, or would be
likely to, prejudice-

(a) the prevention or detection of crime

(b) the apprehension or prosecution of offenders

 

The Authority believes that the release of the registration numbers
together with the information already disclosed could enable the illegal
activity of vehicle cloning.  Section 31 is a qualified exemption and is
subject to the public interest test.  The Authority has considered the
following factors in regard to the release of the exempted information:

For Disclosure

 

-        The Authority’s desire to be transparent and accountable to the
public

-        There is a presumption under the Act in favour of disclosure

 

Against Disclosure

 

-       Release of the exempt information could potentially compromise the
Council’s security

 

Having regard to the circumstances, it is the Authority’s view that, on
balance, the strong public interest in maintaining the exemption outweighs
the public interest in disclosing the withheld information.  

 

In accordance with section 17 of the Freedom of Information Act 2000 this
letter acts as a Refusal Notice as some of the information requested has
been withheld. 

 

 

2.            Of the vehicles leased, a list of the companies from which
the vehicles are leased.

Please find information contained in the attached spreadsheet.

 

3.            Name, position and email address of the staff responsible
for these vehicles.

The vehicles are the responsibility of the Commercial Fleet manager and
the Joint Fleet Services Manager. Whilst we hold the information requested
in respect of the names and e-mail addresses of these staff members we
consider that the information is exempt under Section 40 (2) of the
Freedom of Information Act 2000 which states that:

(2) Any information to which a request for information relates is also
exempt information if –

(a) it constitutes personal data which do not fall within subsection (1),
and

(b) either the first or second condition below is satisfied

(3) The first condition is-

(a) in a case where the information falls within any of the paragraphs (a)
to (d) of the definition of ‘data’ in section 1(1) of the Data Protection
Act 1998, that the disclosure of the information to a member of the public
otherwise than under this Act would contravene-

(i) any of the data protection principles

 

Section 1(1) of the Data Protection Act 1998 states that-

Personal data means data which relate to a living individual who can be
identified –

 

(a)  from those data, or

(b)  from those data and other information which is in the possession of,
or is likely to come into the possession of, the data controller,

 

and includes any expression of opinion about the individual and any
indication of the intentions of the data controller or any other person in
respect of the individual.

 

Under Section 40 of the Freedom of Information Act, the information
requested is subject to an absolute exemption.  This exemption applies
because the information requested would constitute a disclosure of
personal data.

 

The Information Commissioner’s guidance “Access to Information about
public authorities’ employees” and “When should names be disclosed?”
provide guidance on how the Authority should treat requests for
information of this nature.  The Authority considers the information
requested to be absolutely exempt from disclosure by virtue of Section
40(2) of the Freedom of Information Act 2000. 

 

The Authority does not consider that it would be fair in all the
circumstances to identify the individuals as whilst the information
relates to them in their professional capacity, they would not reasonably
expect their details to be placed into the public domain.  The Authority’s
procedure is not to disclose as a matter of routine information about
members of staff below Assistant Chief Executive level. 

 

Therefore, to the extent set out above, this letter acts as a Refusal
Notice in accordance with Section 17 of the Freedom of Information Act
2000 as we have not supplied all of the information requested.

4.            If your refuse collection is outsourced please provide the
name of the company responsible and a list of the vehicles used for this
purpose including vehicle registration mark, fleet number (if used), make
& model and body type.

The contractor for the Waste Management Services Contract is Kier MG
Limited. This contract includes the Refuse collection service. The
information requested is not held by the Authority but by the contractor.

 

 

5.            A breakdown of your marketing and advertising spend.

A total of £444, 1680  is currently shown for Advertising and marketing
for the Financial Year Ended 31.3.14.  This figure could however be
subject to change as the accounts are not yet finalised. Within this
figure £52,969 appears to relate to Newspaper Adverts and £22,990 for
Radio adverts.  Nothing specific to either Bus or Outdoor could be
identified. The total advertising costs will include advertising which in
some cases will have been reimbursed by grant.  The remainder of costs
include advert / marketing for Public Notices,  Brochures / Leaflets, in
Magazines, staffing and for specific events.
