Section 31 Law Enforcement

By virtue of Section 31(a)(b) where public authorities have to consider the balance of the public interest in relation to a request, they do not have to comply with the request until such times as is reasonable in the circumstances.

This is a qualified exemption and there is a requirement to conduct a public interest test. I am obliged to consult with all stakeholders who may be affected by me complying with your request.

An update re 002/2024 was inadvertently sent to your previous WDTK on the 22/01/2024 - which you highlighted back to us and was acknowledged in return.

I have copied it again below so that you have the relevant information on the correct case:

Good Afternoon Mr Swift

I wish to advise you that the following exemption is engaged in relation to your request:

Section 31 Law Enforcement

By virtue of Section 31(a)(b) where public authorities have to consider the balance of the public interest in relation to a request, they do not have to comply with the request until such times as is reasonable in the circumstances.

Upon completion of this process I am then required to ascertain where the balance in compliance with both my duty to confirm or deny what information exists and/or in disclosure of any relevant information.

This process is ongoing, and when considering these matters I am entitled to extend the deadline for complying with your request.

Unfortunately, this does mean that the NPCC has not been able to respond to your request in full within 20 working days of the original receipt.

The new estimated date for compliance will be 20/02/2024, however it may be before this. If you have any queries about this email, please contact me.'

Concerning the response:

A. please identify the police forces (or services) present at the meetings and where a PCC (or PCC employee) which constabulary PCC

B. About 'an explanation, if held, for why the meetings would not be minuted' I am seeking the policy that sets out your approach to meetings and the need to keep records of them, possibly linked to their importance, whether another is designated as the host or lead, or agreement reached that another would keep and circulate a record of the meeting.

C. who kept and circulated the meeting notes and in turn,

D. why did the NPCC seemingly not receive these - they are not disclosed.

I am struggling to reconcile this serious crime, which has increased substantially in the past 5 years, seemingly not being the subject of formal records. Possibly, aside of FoIA (should this not fall to the Act) you could shed some light on this.

I can confirm the following information is held in relation to meeting attendees:

Meeting 23/06/2022
The following police forces or services were represented: NPCC

Meeting 08/11/2022
The following police forces or services were represented: British Transport Police, the NPCC and Police and Police Crime Prevention Initiatives (PCPI).

Meeting 04/04/2023
The following police forces or services were represented: Merseyside, PCPI and NPCC.

Meeting 29/06/2023
The following police forces or services were represented: West Midlands, NPCC, and PCPI.

Meeting 31/10/2023
The following police forces or services were represented: BTP, National Vehicle Crime Intelligence Service (NAVCIS) and PCPI.

There is no information held to suggest that a PCC or PCC employee attended these meetings’

Note:
the NPCC provided brief meeting notes. Apparently, the meetings were not minuted by the NPCC. Seemingly, basic notes of the meeting were kept by the NPCC with no other recording and circulating to the NPCC ‘lead for vehicle crime’
