Procedural Complaint

it has been well over a month and i have still not heard back this is very

DECISION

The MPS acknowledges the delay to you receiving a response to your request
for information under the Freedom of Information Act 2000 (FoIA).

Reason for decision    

The review takes note of your comment in your correspondence ‘it has been
well over a month and i have still not heard back this is very
frustrating.’  In this regard the review can advise you that the statutory
time limit for responding to a request under the FoIA is set out in
Section 10(1) which states that a public authority must comply with
section 1 (1) promptly and in any event not later than the twentieth
working day following the date of receipt.  Therefore, a public authority
must inform the applicant in writing whether it holds the information
requested and if so, communicate that information to the applicant,
promptly, but not later than 20 working days after receipt of the
request.

Your original request for information was received by the MPS on the 28th
February 2015 and therefore a response should have been sent by the 27th
March 2015. In this instance, a full response has not been provided to you
within 20 working days.

The review takes note of the letter sent to you on the 31 March 2015 by
the Information Manager dealing with your request namely ‘I am writing to
advise you that unfortunately there will be a delay in responding to your
FOIA request, which was due on the 27 March.  This has been caused by the
time it has taken to locate where the information requested is held and
finalise a response.  It has been necessary to liaise with MPS Fleet
Services and Traffic departments.  I apologise for this delay and assure
you that a response will be sent to you as soon as possible.’

Despite this letter the review can confirm that, in this instance a
failure to respond to your request within the time limit is a breach of
section 10(1) of the FoIA.

The review has contacted the Information manager dealing with your request
and can confirm it is still in progress. Whilst the review is unable to
provide you with a date for completion, the review can reassure you that
the case is being processed as a matter of priority.

Should you be dissatisfied with the MPS response to your request, once
received, you would still be entitled to request an internal review in
relation to the decision. The review would like to take this opportunity
to apologise for the delay you have experienced and for any inconvenience
caused by our failure to process your request correctly.

request i.e. could you give me a list of all the Police Collisions which
have occurred in Harrow Borough from 1st Jan 2014 to 1st Jan 2015.  For

This letter is to inform you that it will not be possible to respond to
your request within the cost threshold.  To extract the information  would
take at least 8 hours a day over 5 days equalling a totla of at tleast 40
hours. We estimate that the cost of complying with this request would
exceed the appropriate limit. The appropriate limit has been specified in
regulations and for agencies outside central Government; this is set at
£450.00.   This represents the estimated cost of one person spending 18
hours [at a rate of £25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.
 
In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice.
 
Section 17(5) of the Act provides:
 
(5) A public authority which, in relation to any request for information,
is relying on a claim that section 12 or 14 applies must, within the time
for complying with section 1(1), give the applicant a notice stating that
fact.
 
Section 12(1) of the Act provides:
 
(1) Section 1 does not oblige a public authority to comply with a request
for information if the authority estimates that the cost of complying with
the request would exceed the appropriate limit.
 
Section 16 of the Act provides:
