Valuation of Thornaby Old Town Hall

I note that Stockton on Tees Council sold the (Thornaby) Old Town Hall including 3-9 (odd) Mandale Road in November of 2012. Can you please provide the details including any valuations as to how the property was valued at this time, and any deeds of convernant or conditions which were attached to the sale.

I note that Stockton on Tees Council sold the (Thornaby) Old Town Hall
including 3-9 (odd) Mandale Road in November of 2012.  

 

Q1. Can you please provide the details including any valuations as to how
the property was valued at this time.

A1. The background documentation associated with the valuation of Thornaby
Town Hall has been destroyed in accordance with the Council’s retention
policy.  The Council therefore does not hold any records associated with
the valuation of Thornaby Town Hall. 

 

Q2. Any deeds of convernant or conditions which were attached to the sale.

A2. The covenants and conditions attached to the sale are publicly
available from Land Registry (link is as follows:

contained within the Transfer dated 23.11.2012 of title number CE183533.

I am writing to request an internal review of Stockton on Tees Council's handling of my FOI request 'Valuation of Thornaby Old Town Hall'.

Under the Record Management Guidance for Great Britian , the request would fall under the Asset Acquisition and Disposal I believe the documents which i requested should have been held for 12 years as the sale price was 100,000. The authrority has a duty to retain documents 12 years after the obligations/entitlements are
concluded. The documents which should have been retained are as follows:
• Legal documents relating to the purchase/sale
• Particulars of sale documents
• Board of survey
• Leases
• Applications for leases,licences & rental revision
• Tender documents
• Conditions of contracts
• Certificates of approval

A review has been undertaken of the Council's initial response which was
sent to you on 24 September 2019.  The response below provides you with
the outcome of that review. You requested details including any valuations
of how Thornaby Old Town Hall was valued at the time it was sold, and any
deeds of covenant or conditions which were attached to the sale.

The Council's response advised you that the background documentation
associated with the valuation of Thornaby Town Hall were destroyed in
accordance with the Council’s Retention and Destruction Policy.  The
covenants and conditions attached to the sale are publicly available from
Land Registry (link is as follows:

In order to review your request, the Council has checked its Retention and
Destruction Policy, and also looked at the Information and Records
Management Society Retention (IRMS) Guidance for Local Authorities’
document. The IRMS guidance states that:

 

…‘It will give local authorities a base line from which they can build
their own disposal policies.’

 

…‘It should be taken as a baseline for each authority to interpret and
apply appropriately in accordance with local practice.… ‘

 

…‘there is no legal basis for the enforcement and support of these
Guidelines…’

 

The IRMS Retention Guidance is a guidance document that Local Authorities
can refer to when developing their own retention and Destruction Policy. 
Where there are no statutory requirements to retain information for a
specified period of time, a Local Authority can set their own retention
and destruction timescales in-line with business need and good practice.

In this particular instance, Records relating to the disposal of council
property (over £50000) are retained for a period of 12 years from the date
of disposal, and all working papers are destroyed one year after the
purchase is complete. Therefore, the Council is satisfied it has followed
its Retention and Destruction policy in retaining and destroying
appropriate records in-line with its policy.
