information which has been processed under the Freedom of Information Act.
Your request has been considered in accordance with the requirements of
this Act. I can confirm that the Trust is holding records that are
relevant to your enquiry.

 

Request Response
Please would you tell me what, if The Trust claims an exemption from the
any, valuations have been made of need to supply this information under
the property belonging to or section 43 of the FOIA as it is
forming part of the RNHRD (Mineral believed that disclosure is likely to
Water Hospital) in Upper Borough prejudice the commercial interests of
Walls, Bath. Please provide full the Trust. Section 43(2) is a
details of any quotes, estimates or qualified exemption and so
valuations received. consideration has also been given to
the public interest test. It is the
  Trusts position that on this occasion
the public interest is not served in
granting information on the valuations
of RNHRD properties which could impact
and prejudice any future estate
decisions.

satisfactorily answered, then the Trust has an internal review procedure
for dealing with complaints received under the Freedom of Information Act
2000 whereby your case is presented to the Chairman for an independent
review/decision.  Alternatively, you do have the right to complain to the
Information Commissioners Office after any internal review procedure has
been exhausted. The Information Commissioners Office is an independent
body that enforces the Freedom of Information Act, the Data Protection Act

I am writing to request an internal review of Royal United Hospital Bath NHS Trust's handling of my FOI request 'Valuation of the RNHRD (Mineral Water Hospital) site'.

I don't accept that the valuation of a public building is in this case of any commercial sensitivity. A valuation of this property could as easily be obtained by any member of the public or anyone with an interest in acquiring the building so the information can hardly be regarded as sensitive. However I believe it is in the public interest to know what value the RUH places on the property and to know whether or not a valuation has taken place.
