I am writing to request an internal review of Northamptonshire Healthcare NHS Foundation Trust's handling of my FOI request 'Vaccination causing children to collapse Northampton School for Boys 2016'.
You answered a part of my FOI some time ago
"This request relates to an event 18 months ago, which was not caused by an adverse reaction
to a vaccine.
The reason for the reaction the School Nurses saw was extreme anxiety about the vaccination
process which communicated itself rapidly round a room of 14 year old young people.
The vaccine was withdrawn purely as a precaution and was administered without incident at a
later date."

It appears that you have unlawfully delayed answering my FOI request. Furthermore you have answered only because I threatened you with complaining to the ICO
I have still had no answer to part of my request
"Please could you list the reports made on the incident, say which are in your possession and send me them."
Please could you arrange a prompt reply and say why the delay occurred.

The part you did recently answer, you did not even offer an apology for the illegal delay. Please apologise and say why you did not think to do so before, after breaking the law so blatantly.

It appears that you are being as obstructive as you can on this request.

You have claimed exemption 38 of the Freedom of Information act,
as "we believe the release would likely to endanger the health and safety of
the public"
"In this case, we believe that releasing the requested information would be likely to endanger
the physical health of individuals, if use of the information led to the public not wanting to
receive the relevant vaccination.
As referenced above, the investigation into this situation showed that the specific vaccine was
not responsible for the reaction of the students. As such,
releasing the batch number and manufacturer information
could lead to further speculation that could mislead individuals or
the general public and cause them to act or fail to act against their own
benefit, in this case receiving the vaccination.
The trust also feels that releasing this information would undermine the function of the
vaccination programme which is established to protect public health.
It is our belief that releasing this information may further the view that a specific vaccine was
the cause of the adverse effects.
We reached the view that, on balance, the public interest is better served by withholding this
information under Section 38 (1) (a)
of the Act at this time"

I believe you are misusing this exemption to hide this information.
You have not proved endangerment as per ICO guidance-
The endangerment test under section 38
11.
In order to engage this exemption the public authority must
demonstrate that there is a causal link between the endangerment and
disclosure of the information.
12.
The public authority must also show that disclosure would or
would be likely to have a detrimental effect on the physical or
mental health of any individual, or the safety of any individual.
The effect must be more than trivial or insignificant.
13.
The term “would...endanger” means that it is more likely than
not to occur (ie a more than 50% chance).
“Would be likely to endanger” is a lower threshold; this means that even if there is
below a 50% chance, there must be a real and significant likelihood of
the endangerment occurring.
The authority must decide the likelihood of endangerment arising on the facts of
the case. For more details on this, please see our guidance on
the prejudice test.
14.
The assessment of endangerment is relevant to the public
interest test. Note that the choice between “would” and “would
be likely” is important because it affects the balance of factors
in the public interest test. The greater the likely endangerment
to the physical or mental health of any individual, or the safety
of any individual, the stronger the public interest in not
disclosing the information requested.

Further I believe it is incumbent on the Trust to prove the efficacy and safety of the vaccine if you are even attempting to use this exemption.

It was reported in the paper as follows -
"Paramedics had to be called to a secondary school when pupils fell ill and fainted - after being given their vaccinations.
Around 10 to 15 students from Year 10 keeled over after getting their jabs at Northampton School for Boys .
One parent, whose son saw the drama unfold, said children were seen "on their backs on the floor with their legs up on chairs".
The mum, who didn't want to be named, added: "Several different vaccines were being administered, and around 10 to 15 pupils keeled over and paramedics were called.
"Rumours say there may have been a duff batch of vaccines.""

Yet the trust are using an argument that paraphrased goes like this - The reaction of the children was caused not by a vaccine as reported but by extreme anxiety, yet we will offer no proof, nor answer the part of the request that asked for this. If we do release the information to the public, people are so stupid that they will make a wrong decision based on an incorrect understanding of the facts and they will endanger their childrens health. We know better than them, so we are not giving them the opportunity to make up their own minds from the facts, to keep them in ignorance and compliance with what we want.
