Dear East Lindsey District Council,

I would be grateful if you could provide a list of all industrial properties (not just properties owned by the council) across the borough which are currently classed as vacant for rating purposes, with an RV greater than £2600.

Where possible, please also provide details of ownership of said properties.

Please provide this information in Excel spreadsheet format.

Re: Freedom of Information Act 2000 - Information Request

I acknowledge your request for information received on 3^rd December 2010

Your request is being considered and you will receive the information
requested within the statutory timescale of 20 working days as defined by
the Freedom of Information Act 2000, subject to the information not being
exempt or containing a reference to a third party.

If appropriate, the information may be provided in paper copy, normal font
size. If you require any alternative formats, e.g. language, audio, large
print etc. then please let me know.

For your information, the Act defines a number of exemptions that may
prevent release of the information you have requested. There will be an
assessment and if any of the exemption categories apply then the
information will not be released. You will be informed if this is the
case, including your rights of appeal.

There may be a fee payable for this information. If the estimated cost of
providing information exceeds the £450 limit we will contact you to ask
if you are happy to pay and will not proceed until we have your
confirmation.

We will charge disbursement costs in all cases where costs exceed £10.
Disbursement is the cost of physically producing the information and
posting it to you if required. Where we intend to make a charge we will
inform you and you will need to make payment before we let you have the
information. You will be able to pay and collect your information from us.

Costs include:

· Photocopying or printing material (10p per A4 sheet, 20p per
double paged sheet)

· Postage

· Producing material in an alternative format at the request of
the applicant, such as putting it onto CD-Rom, video, or audio cassette

· Providing extracts of databases

· Translating information into a different language at the
request of the applicant.

Re: Freedom of Information Act 2000 - Request for Information 409/12/10

Thank you for your recent request for information. Your request has now
been considered under the terms of the Freedom of Information Act 2000 and
our response is outlined below.

You asked:

I would be grateful if you could provide a list of all industrial
properties (not just properties owned by the council) across the borough
which are currently classed as vacant for rating purposes, with an RV
greater than £2600.

Where possible, please also provide details of ownership of said
properties.

In accordance with Section 1(1)(a) of the Freedom of Information Act 2000
you are advised that the Council does hold the information requested.

Where the owner is an individual I am unable to provide the information
you have requested, this is because it is personal information and
therefore exempt from disclosure under Section 40(2) of the Freedom of
Information Act 2000. This is line with the Information Tribunal's
decision in the matter of Mr Colin England and London Borough of Bexley v
The Information Commissioner (2007). In this case it was decided that the
addresses of empty properties could only be given when they were not owned
by individuals and that the owner names could only be given where they
were not individuals.

In order to comply with your request (taking the above into account)
please find attached a spreadsheet giving details of:

(a) addresses and rateable values of empty commercial properties in
the East Lindsey District Council area that have a rateable value ob
£2600; and

(b) the names of the owners of those properties referred to in (a)
where they are not classed as personal information.

Please note that cells marked with *** have had personal information
removed from them.
