Dear Mr Wetherby,

I refer to your Freedom of Information request received by Braintree
District Council.

The Freedom of Information Act enables access to information held by the
Council, subject to the exemptions contained within the Act. The Act does
not require the Council to create information to respond to a request if
the requested information is not held, nor to give an opinion or comment.

With regard to your request, The attached document contains the
information that the Council holds in respect of your request with the
exception of the details of properties which relate to a sole trader or an
individual and details of ownership.

With regard to properties which relate to sole traders or an Individual,
whilst this information is held by the Council, where the rate payer is a
sole trader or an individual the Council considers that it is exempt from
disclosure under S 40(2) Personal information of the Freedom of
Information Act 2000. The Council considers the name, addresses and
account reference to be personal data - data which relate to a living
individual who can be identified (a) from those data, or (b) from those
data and other information which is in the possession of, or is likely to
come into the possession of, the data controller.

Regarding ownership details, the Council does not hold details of the
owners of the premises. The information provided relates to those who are
liable to pay the non domestic rates. The Council cannot guarantee that
the names provided are those of the owners.

If you disagree with the CouncilÂ*s decision in respect of your freedom
of information request or are otherwise unhappy with how the Council has
