V112 - Exemption from MOT

Response to this request is long overdue. By law, under all circumstances, Driver and Vehicle Licensing Agency should have responded by now (details). You can complain by requesting an internal review.

Dear Driver and Vehicle Licensing Agency,

The government website https://vehicleenquiry.service.gov.uk/ enables you to check the MOT status of a vehicle.

Does this website include the status of vehicles where a V112 declaration of no MOT required has been submitted?

Yours faithfully,

Nick Leaton

FOI, Driver and Vehicle Licensing Agency

Dear Mr Leaton

Thanks for your email. I have forwarded your request to the Driver and Vehicle Standards Agency (DVSA) who are best placed to answer your question. They have confirmed they will respond to your request.

Dear Mr Leaton

Thank you for your email enquiry dated 31 August 2021, concerning V112
exemption document.

The DVLA operate the Vehicle Check service, so you will need to contact
them for advice on the information displayed on it.

The DVLA Email Service can be found [1]here
Telephone: 0300 790 6801 for drivers queries.
                    0300 790 6802 for vehicle queries.

However, under new legislation that came into effect on 20 May 2018,
certain vehicles constructed or first registered more than 40 years ago
are now exempt from MOT testing, unless they have been substantially
changed.

As long as the DVLA have a date of manufacture/first use on the vehicle
record which shows the vehicle is over 40 years old, the on-line tax
renewal system and other enforcement systems should automatically pick up
that the vehicle is MOT exempt.

If, for some reason, the system is still not allowing a vehicle to be
taxed, there is also a V112 (self-declaration from MOT) application form
that can be completed and taken to a Post Office.

The V112 can be found [2]here and was updated to show the above exemption
on 20 May 2018.

I hope this information has assisted you with your enquiry, but if you
have any further questions please do not hesitate to contact us again.

Kind Regards

Dear Driver and Vehicle Licensing Agency,

This is doesn't quite answer my question. V112D is for more than 40 year old vehicles. Perhaps I wasn't clear enough.

V112D forms can be used for more than 40 year old vehicles. Other vehicles can have V112D declarations.

https://vehicleenquiry.service.gov.uk/ allows you to check on vehicle MOT status.

1. Do V112D declarations flow through to MOT status?

My guess is correct, or anyone with an exempt vehicle would constantly alert the police on the ANPR systems. [https://www.police.uk/pu/advice-crime-pr...

2. Do you have to make an annual V112D declaration?

Yours faithfully,

Nick Leaton

Dear Mr Leaton,

Thank you for your email of 6 September. I confirm that I do not consider
this a freedom of information (Foi) request and am therefore responding as
business as usual.

Your request and our response is as follows:

This is doesn't quite answer my question. V112D is for more than 40 year
old vehicles. Perhaps I wasn't clear enough.

V112D forms can be used for more than 40 year old vehicles.  Other

[2]https://vehicleenquiry.service.gov.uk/ a... you to check on vehicle

 2. Do you have to make an annual V112D declaration?

Our response:

I am sorry if the previous response was unclear or did not answer your
questions. I can confirm the vehicle enquiry service you have provided the
link for, does not include vehicles that have been registered as MOT
exempt, via form V112D.

Exempt MOT vehicles will either show an expired MOT if the vehicle has
previously had an MOT, or that no MOT details are held if no MOT has ever
been carried out on the vehicle.

Each time an exempt vehicle is due to be taxed, a new V112D form needs to
be completed, as a vehicle cannot be taxed without either a valid MOT or a
new V112D form.

Yours sincerely

Dear [email address],

Thank you for the response on the V112D needed for taxing purposes. That is clear.

But other parts of your response cannot be correct. I've picked one vehicle at random.

SV13 BGX is a police vehicle. The evidence for this is here. https://youtu.be/EAD0frLyJ6w?t=50

FIrst registered in March 2013. So at 8 years old, if it wasn't a police vehicle it would need an MOT. It's taxed, so that means a V112D. Looking at "is it taxed" it shows up as having an MOT. You have said it should show up as not having an MOT.

So somehow your answer cannot be correct.

Can you explain?

Yours sincerely,

Nick Leaton

Dear Mr Leaton,

Information requested under the Freedom of Information Act (FoIA)

Further to your email of 15 September, I can confirm that we have handled
your request for information within the terms of the FoIA.

Your request and our response is as follows:

Thank you for the response on the V112D needed for taxing purposes. That
is clear.

Can you explain?

Our response:

Firstly, thank you for bringing this to our attention and assure you that
we have passed this anomaly on to our MOT team today, to investigate.

As you have asked about a specific vehicle which you don’t own, the
information relating to it is withheld from disclosure under section 40(2)
of the FoIA (personal information). This is because the information you
have requested does not constitute your own personal data, and as such you
do not hold the necessary access rights for disclosure.

Further information on section 40 of the FoIA can be accessed via the
following link:

[3]https://www.legislation.gov.uk/ukpga/200...

The DVSA hold no records in relation to ownership of a vehicle. This
information is held by the Driver and Vehicle Licensing Agency (DVLA). As
such, I am unable to explain why this particular vehicle has a current
MOT.

If you are unhappy with the way we have handled your request, you can ask
for an internal review to be conducted by our Information Management and
Security Team by emailing: [4][email address

Yours sincerely
