Thank you for your request of 6 February in which you asked for the
following information:
1 A current list of council employees who have authority to make a
request for powers under RIPA and under what circumstances.
2 Details of the use of powers under RIPA by your council since the
Act came into force: who made the request, the purpose thereof, the
intention for the request, and date and outcome of request.
Taking your questions in turn:
1 A current list of council employees who have authority to make a
request for powers under RIPA and under what circumstances.
Oxfordshire County Council cannot provide you with a list of council
employees who have authority to make a request for powers under RIPA as
such a list does not exist. This is because technically there is no
limitation on who can apply for authorisation to carry out activities that
fall within the scope of RIPA. However, many County Council employees
would not within the scope of their employment carry out duties that
include any activity that falls within the scope of RIPA since
authorisation can only be given if the activity is:
. necessary for purposes specified within the act (in practice, for
the purposes of prevention or detection of criminal offences),
and if
. the proposed activities are proportionate to what is sought to be
achieved.
With regard to officers who provide authorisation, please see the attached
list.
2 Details of the use of powers under RIPA by your council since the
Act came into force: who made the request, the purpose thereof, the
intention for the request, and date and outcome of request.
Since the Act came into force in 2000, RIPA powers have been requested
for:
o Directed Surveillance
o Use of a Covert Human Intelligence Source (CHIS)
o Acquisition of communications data

council's use of RIPA authorisations.
