Please provide information on whether the ICB used the Prince of Wales Pub in Stowe Maries for engagements events hosted or facilitated by the ICB.

Please provide any notes, emails, correspondence, invoices, or documents pertaining to individuals or companies involved in booking the pub for these events, including the rationale of hosting the events at such a facility, whether other facilities (council or NHS owned) were considered and why they were deemed unsuitable, and any suitability assessments carried out to establish that this facility was best placed to serve the audience the ICB were looking to attract with these events.

I refer to your request dated 30^th January 2024 made under the Freedom of
Information Act, for records held by NHS Mid and South Essex Integrated
Care Board. I refer also to the acknowledgement of your request which was
sent to you on 31^st January2024

 

I am now writing to advise you that it is necessary to extend the period
for consideration of your request by 20 days. There is provision specified
in the Act to claim a reasonable extension, up to an additional 20
working days, we you need more time to consult with third parties and to
consider the public interest test.

 

This means that the now deadline is calculated to be 26^th March 2024

 

However, I will do everything to get this to as soon as possible.

Dear Mr Zolton,

 

Further to the acknowledgement below, we are getting in touch with regards
to your FOI request.

 

Because some of the information requested, in relation to assessments and
invoices, has the potential to come under one of the qualified exemptions
in the FOI Act, namely Section 43(2) – release of information would, or
would be likely to, prejudice the commercial interests of any legal person
(including the public authority holding it), the ICB must pull together
and consider a public interest test, weighing the points for disclosure or
withholding, to be considered by our Senior Information Risk Owner (SIRO).

 

As such, under Section 10(3) of the FOI Act, we are writing to let you
know that we are extending the deadline of this request in order to carry
out the public interest test. As per ICO guidance, this extension should
be for no more than an additional 20 days, therefore the revised deadline
is 25^th April 2024, although we will endeavour to respond at the earliest
opportunity.

I note with regret that your deadline of 25th April 2024 has passed. It is now 2nd May 2024 and under the relevant legislation, this request should have been answered long ago.

Please can you update me on the status of your determinations under Section 43(2) and the decision that your SIRO has come to please?

Good morning Mr Zolton,

 

We are aware of the passing of the extended deadline and can only
apologise to you for this, however I can confirm that we are still working
on your requests – both are proving more complicated than first expected,
we are still trying to fully gather all the relevant information to be
considered as part of your responses.

Dear Mr Zolton,

Further to your request under the Freedom Of Information Act, received on
30th January 2024, please find NHS Mid and South Essex Integrated Care
Board’s response attached.

Please accept our sincere apology for the delay in getting this FOI
response to you.

Unfortunately, due to staff changes as a result of restructures, and
resulting closure of associated staff accounts, information relating to
this request was not readily available and it took some time to be able to
bring it all together. We are now assured that all avenues have been fully
explored, and as such have now been able to produce this response.

FYI – with regards to your other outstanding request, the above also
applies to that, however we are still finalising the response before
release to you. This is currently with our SIRO for consideration;
therefore we anticipate that response will be with you in the next few
days.

If you are dissatisfied with the response you have received, you have the
right to request a review of our decision or make a complaint about how
your request has been handled. Your request should be made within 40
working days of receipt of this letter, and we will reply within 20
working days of receipt. Any such request received after 40 working days
will only be considered at the discretion of the organisation.

If our decision is unchanged following a review and you remain
dissatisfied with this, you then have the right to make a formal complaint
