Use of Regulation of Investigatory Powers Act (RIPA) 2000

The request is waiting for clarification. If you are Les Keene, please sign in to send a follow up message.

Dear Sir or Madam,
Following reports in the media concerning the use of the Regulation of Investigatory Powers Act (RIPA) 2000, I would like to know, since RIPA was passed:

1) On how many occasions South Gloucestershire Council has conducted an investigation, surveillance operation or made a request for an individual’s communication records (either internet or telecommunications) under the RIPA, by year,

2a) The dates that the individual requests were made,
2b) In each instance above: The type of investigation for which the request for surveillance was made (or a reason why the request or relating to offence evidence of which was being sought by means of the surveillance),
2c) In each instance above: The ethnicity and gender of the person targeted by the request,
2d) An indication if the target of the request resided outside of the Unitary authority boundary area.

Finally is it possible to tell me the following:

3) How many individuals within the authority are authorised to request surveillance/ information via RIPA, and what is their job description and/ or designated grade?

4) Have any employees in (or third parties working for) the authority ever been investigated or disciplined for the misuse or alleged misuse of a member of the public’s personal information that has been obtained using RIPA powers?

5) What safeguards are currently in place within your authority to prevent the illegitimate use/ misuse of personal/ communications information obtained via RIPA? This might involve an explanation of the processes are in place to ensure that officers, employees or consultants attached to the organisation, and concerned with such requests, cannot make illegitimate use of the RIPA legislation.

Yours faithfully,

Les Keene

Freedom of information, South Gloucestershire Council

Dear Les Keene,

Further to my email dated 22^nd September 2014, I am writing to advise you
that, in relation to questions 2C and 2D, whilst we may hold this
information, the format that it is currently held in may mean that it
could take the authority more than 18 hours to gather the information.  In
line with the councils policy for dealing with Freedom of Information
requests, this will incur a cost of £25 per hour for every hour over the
18 hours (as specified above), with a maximum limit of £450.

I have been advised that questions 2C and 2D are answerable within the
timescale if the request relates to information from the past 3 years,
rather than since the Act’s implementation. I would be grateful if you
could please confirm if you are happy to receive information regarding Use
of Regulation of Investigatory Powers Act 2000 from within the last 3
years.

If you are not happy to receive this information, and would like to
continue with your original request and accept the costs as outlined
above, I would be grateful if you could please confirm this as well.

I would be grateful if you could please let me know your intentions by no
later than the 1^st October 2014. I would like to advise you that your
request has currently been put on hold for this time, and it will continue
to be processed once I receive your response.

I look forward to hearing from you.

Yours sincerely,

Dear Les Keene,

Further to my email dated 24th September 2014, I am writing to advise you of a few corrections from my previous email. With regards to questions 2C and 2D, the information I provided you with was incorrect. Please see below the revised information for your consideration.

In relation to questions 2A and 2B, the information you have requested can be provided for the whole starting period of the Use of Regulation of Investigatory Powers Act 2000. However, the format that it is currently held in may mean that it could take the authority more than 18 hours to gather the information. In line with the Council's policy for dealing with Freedom of Information requests, this will incur a cost of £25 per hour for every hour over the 18 hours (as specified above) with a maximum limit of £450.

I have been advised that questions 2A and 2B are answerable within the timescale if the request related to information from the past 3 years, rather since the Act’s implementation. I would be grateful if you could please confirm if you are happy to receive information regarding Use of Regulation of Investigatory powers from within the last 3 years.

If you are not happy to receive this information, and would like to continue with your original request and accept the costs as outlined above, I would be grateful if you could please confirm this as well.

In my previous email, I asked if you could please let me know your intentions by no later than the 1st October 2014. I would like to ask that you confirm your intentions with regards to my revised email on the 1st October 2014, as previously requested.

I would like to remind you that your request is still on hold, and it will continue to be processed once I receive your response.

I apologise for any inconvenience that is being caused as a result.

I look forward to hearing from you.
