It has been brought to our attention that an article was published in the national press in 2008 regarding a freedom of information request made to the Association of Police Authorities by Chief Constable Paul Kernaghan who was said to have used a false name.

As the police authority for Hampshire Constabulary you no doubt will have some information regarding this matter.

1. Please provide copies of any documentation concerning this matter including memos, reports and e mails.

Dear Hampshire Police Authority,

The news article stated that Chief Constable Kernaghan was snubbed by the association of police authorities and attempted to obtain the same information by using a false name in a freedom of information request to the Association of police authorities.

This was in the national press and could be seen to be unethical in that a Chief Constable was prepared to use a false name to obtain information.

We would like to see any documentation concerning this matter including any correspondence between the APA, HPA and Hampshire Constabulary.

There appears to be a prima Facie case of breaching the the standards for professional behaviour in relation to Mr Kernaghan's actions and the police authority are the appropriate authority to deal with such matters concerning a Chief Constable.

You submitted a request on 13 August 2011 under Freedom of Information for information held by Hampshire Police Authority.

Your request was for any documentation (memos, reports or emails) concerning an article published in the national press in 2008 regarding a freedom of information request made to the Association of Police Authorities by ex Chief Constable Paul Kernaghan who was said to have used a false name.

The Authority asked for clarification of your request and you responded on 17 August 2011 that your request related to any documentation, including any correspondence between the APA, HPA and Hampshire Constabulary, concerning the use by Mr Kernaghan of a false name to obtain information.

Response
Hampshire Police Authority can neither confirm nor deny that it holds the information you requested as the duty in s1(1)(a) of the Freedom of Information Act 2000 does not apply, by virtue of the following exemptions:

S40(5)(a)(i) Personal information
Information disclosed under the Freedom of Information Act is disclosed into the public domain, effectively to the world, not just to one individual. To confirm or deny whether personal information exists in response to your request could publicly reveal information about an individual or individuals, thereby breaching the right to privacy afforded to persons under the Data Protection Act 1998.

Consequently, Hampshire Police Authority would not confirm or deny whether a named individual had made a request for information under FOI since this would leave the Authority in breach of the Data Protection Act. In cases such as these, section 40(5) becomes an absolute exemption, and there is no requirement for me to provide evidence of the prejudice that would occur, or to conduct a public interest test.

Where personal information is requested under FOI that relates specifically to the applicant or a third party, anything other than a neither confirm nor deny response would inadvertently disclose personal information.

I am writing to request an internal review of Hampshire Police Authority's handling of my FOI request 'Use of false name by Chief Constable Paul Kernaghan'.

Mr Kernaghan's name is alreday in the public domain and this is a matter of public interest. A senior officer is acting in a manner which is not conducive with his role and position as a Chief Constable.

It is your role as the police authority to deal with such issues relating to senior officers.

We have obtained a copy of an article which has been published below and we wlould ask you to review your decision not confirm or deny and supply any available information in this matter.

‘I’m Gene’ says cop in fact Hunt

ONE of Britain’s senior cops used the alias of Life On Mars antihero Gene Hunt to find out about top brass perks.
Hampshire Chief Constable Paul Kernaghan went undercover while negotiating pay rates with the Home Office.
He chairs the Chief Police Officers Staff Association – but a Freedom of Information request to the Association of Police Authorities under its own name had been snubbed.
So the Ulsterman, 52, exercised his legal right not to be identified – and in February made another request in the name of BBC TV?s hard-drinking, no-nonsense DCI Hunt – played by Philip Glenister.
His e-mail asked if assistant chief constables and ranks above were eligible for cash bonuses on crime performance statistics. It also called for details about cars, health insurance and if school fees were paid by authorities in salary packages.
He cheekily signed off with ‘Many Thanks, Hunt Research’.
Mr Kernaghan admitted: An FoI request was submitted under a pseudonym to establish facts to be used in ongoing pay negotiations?
