Use of Facebook Profiles in Investigations

We're waiting for David Ledsom to read a recent response and update the status.

Dear Wrexham County Borough Council

Please find the below request, as two seperate requests- one to the Planning Department and the other to the Trading Standards Department.

1) Does the authority allow its investigative officers to use Facebook as a means of obtaining intelligence or any other information which would contribute to an investigation?

2) If yes, I would like to know how many ‘Facebook Profiles’ have been used to access Facebook and gather evidence or intelligence which has contributed to an investigation.

3) Of the profiles used for the purpose of accessing information on Facebook, how many were:

A) Overt profiles in the officers own name;

B) Covert profiles using a pesudonym or concealed identity.

4) Does the authority permit the use of pseudonym Facebook Profiles for the purpose of making contact with unsuspecting offenders?
Eg investigating rogue traders Or planning law breaches.

5) If yes to the above, have officers been received training on such methods of investigation, specifically the use of social media profiles in a covert manner?

Response:

 

Section 1(1)(a) – The duty to confirm or deny

Section 1(1)(a) of Freedom of Information Act requires the local authority
to inform a requester whether it holds the information specified in the
request. This is known as ‘the duty to confirm or deny’. However, there
are occasions when complying with the duty to confirm or deny under
section 1(1)(a) would in itself disclose sensitive or potentially damaging
information that falls under an exemption.  Therefore the local authority
are not in a position to confirm nor deny that the information requested
is held or not.

 

If you are unhappy with the way the Council has handled your request, you

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
