Use of DARD Central Investigation Services

Dear Arts Council of Northern Ireland,

In 2010 an investigation was conducted into the activities of the [Potentially defamatory material removed] Mr [Potential defamatory material removed], by Deloitte consultants as instructed by the DARD PS Mr Gerry Lavery. The findings of this investigation showed there was elements of corruption, malpractice and mis/malfeasance in the workings of Mr [Potential defamatory material removed] and this unit on the instructions of Mr [Potential defamatory material removed].

1. Can you confirm if the Art's Council uses any of the DARD CIS resources?

2. If so, can you confirm the legal basis enabling DARD CIS to conduct business on behalf of the Art's Council and the annual cost of this service for the last financial year?

3. If the Art's Council do use this DARD service can you clarify if you have taken any action to review any agreement with DARD CIS in light of the investigation findings of the Deloitte investigation in 2010? And the subsequent findings and action taken as a result of any review.

I am writing to confirm that the Arts Council of Northern Ireland has now
completed its search for the information in relation to the use of DARD
Central Investigation Service.
 
In response to your request, I would advise the following:
 
1.Can you confirm if (named ALB) uses any of the DARD CIS resources?
Fraud training and fraud investigations  conducted on the Arts Council’s
behalf are subject to a service level agreement between the Department of
Culture Arts and Leisure (DCAL) and DARD CIS. 
 
2. If so, can you confirm the legal basis enabling DARD CIS to conduct
business on behalf of the Arts Council and the annual cost of this service
for the last financial year?
Fraud training and fraud investigations are subject to a SLA between DCAL
and DARD CIS. The cost of the service for 2011/12 was £13,019.25.
 
3. If the Arts Council do use this DARD service can you clarify if you
have taken any action to review any agreement with DARD CIS in light of
the investigation findings of the Deloitte investigation in 2010? And the
subsequent findings and action taken as a result of any review.
The Department is content with the quality of service that it receives
under the terms of the service level agreement. A new SLA has been agreed
for the period 1 April 2012 to 31 March 2015.
