As part of the new European General Data Protection Regulations (GDPR), there are changes to the data subject’s rights, including how a Trust operates its Subject Access Request processes.
All staff who support the Subject Access Team in relation to pulling and collating records and sending them to the team for processing should be mindful that the number of days to turn the request around is now 28 days.

Further to your email below, I can now respond to your request clarification dated 2nd December 2019.
Pennine Care NHS Foundation Trust (the Trust) does not hold the information that you have requested in an easily retrievable format. The reason for this is that the information is not held centrally and we would need to amalgamate and then summarise a large number of spreadsheets, sixty to be precise that are in various formats. As such, this would take over the legal requirement of 18 hours.
Therefore, as per Section 12(1) of the Freedom of Information Act 2000, the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with the S.17 of the Freedom of Information Act, this correspondence is your Refusal Notice for that information.
In accordance with S.16, the duty to advise and assist, I can advise that we can provide the Medical agency spend. Please advise if you would like to receive this information.

Following receipt of your request, searches were conducted within Pennine
Care NHS Foundation Trust (the Trust) to locate the requested information
and I can confirm that the information requested is not held by the Trust.
“Could you please supply the cost to the Foundation (or whoever pays the

2015/16”
Apologies, as I appreciate this does not tally with the response
previously provided, that advised the request would take in excess of 18
hours. Having now seen the data myself, I understand it isn’t actually
held by the Trust.
To provide the cost of each individual locum, we would need to undertake a
series of calculations that we are not able, or required, to do by the
Act. To help you understand the information we hold, I provide the
headings from the spreadsheet HR use to show you the information they
capture and to evidence we do not hold a worker total.
As a gesture of goodwill, however, the HR team contacted Staff Flow. They
are an external body we use to recruit most of our locums. They were able
to provide us with the cost per worker that you have requested. Please
note, this isn’t information Pennine Care held at the time of your request
and it has been retrieved, on this occasion, only to assist you in this
request. Please find their data attached.
