USAF facilities in UK. Terms and conditions for use.

The request was partially successful.

peter rutherford

Dear Ministry of Defence,

We have been pleased to offer the United States military numerous types and kinds of facility in this country, including the use of airfields, often called RAF xxxxxxx but in actuality being USAF bases.

What are the terms and conditions under which these facilities are made available to the USA?

In the event of the office of US presidency being occupied by a person deemed by many people to be unsatisfactory to the point of almost being a threat, what freedom do we have to revoke these privileges before any lease terms might run out (if appropriate)?

Thank you.

Yours faithfully,

Peter Rutherford

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

Thank you for your reply. I asked for the Terms and Conditions, which should have included any time period for a "Notice to Quit". Please advise any NTQ terms that might be applicable in the event of a temporary suspension of the arrangement, or rather less likely, of a shut down of the arrangement.

Thank you.

Yours sincerely,

Good Afternoon Peter

For some reason you keep sending FOI requests to the iHUB Group Mailbox. This mailbox is frequently monitored but will eventually be closed down.

If you require a FOI request regarding USAF Facilities, I believe you need to redirect your Paul Dale, CAS-AS International 3a. (My apologies Paul if you are not the correct person).

Kind Regards

Dear Mrs Abramovici,

I am replying to the email address that I have been supplied by the MOD. Where do you imagine that I got it from? If it is the wrong one, then please tell them not to keep sending the wrong one and send me the right one. It's not rocket science.

In the meanwhile, please will you action the message I sent asap.

Thank you.

Dear Mr Rutherford,

Thank you for your e-mail dated 27 May.

As I explained in my letter dated 27 May, bases are made available to the
US Visiting Forces under the terms of the NATO Status of Forces Agreement
(SOFA) of 1951.   The NATO SOFA is available in the public domain at:
[1]http://www.nato.int/cps/en/natohq/offici... There are
no Notice to Quit terms in relation to the use of the bases.

If you are not satisfied with this response or you wish to complain about
any aspect of the handling of your request, then you should contact me in
the first instance. If informal resolution is not possible and you are
still dissatisfied then you may apply for an independent internal review
by contacting the Information Rights Compliance team,
[2][email address]). Please note that any request for an internal
review must be made within 40 working days of the date on which the
attempt to reach informal resolution has come to an end. 1^st Floor, MOD

If you remain dissatisfied following an internal review, you may take your
complaint to the Information Commissioner under the provisions of Section
50 of the Freedom of Information Act. Please note that the Information
Commissioner will not investigate your case until the MOD internal review
process has been completed. Further details of the role and powers of the

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

Thank you for your email of June 24 which supplies a replacement to the faulty link previously provided. I note that the document provides nothing relating to the NTQ query.

I understand that there are no Notice to Quit terms and therefore any requirement by HMG to leave, albeit temporarily, would be effective immediately. Please confirm if this is not the case

Yours sincerely,

Peter Rutherford

Dear Mr Rutherford,

Thank you for your e-mail.

Any requirement to leave would not be immediate. It would be subject to a period of consultation.

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

Thank you for your letter of June 30th.

1. What is this period of consultation?
2. It would all seem to me to be reasonably straightforward; what are the issues to be consulted about?

Yours sincerely,

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

Dear Mr Rutherford,

Thank you for your further e-mail dated 30 June.  Please accept my
apologies for not responding within twenty working days of your message.

You posed a further two questions in relation to the use of bases by the
United States Visiting Forces:

1. What is this period of consultation?

2. It would all seem to me to be reasonably straightforward; what are the
issues to be consulted about?

In the event the UK Government decided to no longer make a base available
a period of consultation would precede the formal notification to vacate.
This would allow for various matters to be considered by both parties.
From an MOD perspective this would include such issues as the future use
of the base and the implications for MOD personnel employed at the base.

Yours sincerely

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

I find your reply of August 1st uninformative and unhelpful. In my view, what you have said seems improbable.

Nobody imagines that we, as a people, would wish to deprive permanently a close ally of a service that they value and is useful to us. However, on a temporary basis, for maybe for, say, four years, this is a possibility and I do not believe that the MOD is as caught out as it appears to be.

I expect a full response by this Friday noon, failing which I will apply for a review and file a formal complaint.

Yours sincerely,

Peter Rutherford

Dear CAS-AS iHUB GroupMailbox (MULTIUSER),

Thank you for your reply dated august 10th. I find it impossible to believe that the MOD, tasked with identifying and providing for all threats to the country have, in this instance, so thoroughly been caught napping. Therefore, I have applied for an Internal Review using the email address provided.

Dear CIO-FOI-IR (MULTIUSER),

Your response indicates that you have not considered this matter, and haven't any idea what might/could happen if it were to be deemed necessary.

You have had well over 4 months to think about it and STILL HAVEN'T GOT A CLUE. I would have thought that an agency that spends £100m per day, 365 days a year would have had the resources to keep on top of its job. If it is not down to the money, it must be down to the people.

You are a disgrace.

Yours sincerely,

Peter Rutherford
