The litigation in SSWP v AT (AIRE Centre and IMA Intervening) [2022] UKUT 330 (AAC); SSWP v AT [2023] EWCA Civ 1307 is now concluded (with the Supreme Court having refused the SSWP permission to appeal on 07/02/2024).

Please provide:

1. Any updated guidance about how decision makers and case managers should apply the decision of the Upper Tribunal and Court of Appeal.

2. Any instructions on the Decision Makers Notice Board about the case.

3. Any updated guidance or instructions about now deciding the cases which were stayed during the litigation.

2 months after this litigation ended the DWP have yet to update their guidance and, it seems, are still telling Decision Makers to stay decision making in cases when they have no lawful authority to do so.

Not great.
