Request for information under the Freedom of Information Act 2000
Further to your request for information, made under the provisions of the
above Act, please see below our response. May I also take this opportunity
to apologise for the delay in responding to this request.
1. What are the contractual performance KPI's for this contract?
Please find attached information.
2. Suppliers who applied for inclusion on each framework/contract and
were successful & not successful at the PQQ & ITT stages
The names of the unsuccessful tenderers we believe are exempt from
disclosure by virtue of Section 43 of the Freedom of the Information Act.
The OJEU award notice (2017-043698) outlines the information provided in
line with the authorities obligations under PCR 2015 in relation to the
publication of the contract award information, the authority is not
obligated to provide additional information such as naming the
unsuccessful bidders.
Regarding the above disclosure of the unsuccessful bidders would, or would
be likely to, prejudice the commercial interest of the County Council
and/or other organisations with which we conduct business, and this may
include the disclosure of trade secrets. The Information Commissioner's
Office (ICO) guidance on the application of S43 states that "a commercial
interest relates to a person's ability to participate competitively in a
commercial activity, i.e. the purchase and sale of goods and services". A
tendering process is a commercial activity, given that this is a
competitive process, by which the Authority intends to select a provider
or deliver a service.
3. Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date.
Please see the attached spreadsheet for contracts CR/CORP/LCC/23/204 and
CR/CORP/LCC/21/1071.
4. Start date & duration of framework/contract?
• CR/CORP/LCC/23/204 – Commenced 31^st July (Lots 1 to 7) 1^st September
2023 (Lots 9 to 17) and 1^st December 2023 (Lot 8) (initial 1 year
contract) option to extend for further year until 30^th July 2025,
31^st August 2025 and 30^th November 2025 respectively.
• CR/CORP/LCC/21/1071 – Commenced 1^st September 2021 (initial 2 year
contract) option to extend up to a further 2 years until 31^st August
2025 for the Frozen Lot 10 only, all other Lots (1 to 9) ended on 31
August 2023.
5. Could you please provide a copy of the original blank response
documents?
Please find attached documents for contracts CR/CORP/LCC/23/204 and
CR/CORP/LCC/21/1071.
6. Is there an extension clause in the framework(s)/contract(s) and, if
so, the duration of the extension?
Yes.
CR/CORP/LCC/21/1071 can be extended until 31^st August 2025.
For CR/CORP/LCC/23/204 – Lots (1 to 7) until 30^th July 2025, Lot 8 –
30^th November 2025 and Lots 9 to 17 (No Lot 16) until 31^st August 2025.
7. Has a decision been made yet on whether the framework(s)/contract(s)
are being either extended or renewed?
No
8. Who is the senior officer (outside of procurement) responsible for
this contract?
Details of the names and contact information for employees below the grade
of 'Head of Service' is exempt under Section 40(2)(a) of the FOI Act.
Releasing details of employees below this grade into the public domain
would be unnecessary and unfair due to their reduced responsibilities in
terms of senior decision making responsibilities and accountability.
Disclosure would be against the legitimate expectations of the individuals
concerned and therefore would be a breach of the first data protection
principle as set out in Article 5(1)(a) of the UK General Data Protection
Regulation.
