I would like to request a list of your current contracts with suppliers over the value of £5,000 or over.

As a minimum, please include:
Reference number
Title of agreement
Local authority department responsible
Description of the goods and/or services being provided
Supplier name and details
Sum to be paid over the length of the contract or the estimated annual spending or budget for the contract
Value Added Tax that cannot be recovered
Start, end and review dates
Whether or not the contract was the result of an invitation to quote or a published invitation to tender, and
Whether or not the supplier is a small or medium sized enterprise and/or a voluntary or community sector organisation and where it is, provide the relevant registration number.

Further to your request for information about Up to date details of
current contracts over £5,000 I can tell you the following:

Under the FOI Act the information is exempt from disclosure under the
provisions of section 21. Section 21 sets out that the local authority
need not provide information under the FOI Act where the information
requested is ‘ reasonably accessible’ by other means.  The information

“Value Added Tax that cannot be recovered”

 

In line with VAT Act 1984 (as amended), as a local authority, where a
valid VAT invoice is provided the council recovers all VAT on all items of
expenditure, as the council has not breached its partial exemption limit.

           

“Whether or not the contract was the result of an invitation to quote or a
published invitation to tender, and          

Whether or not the supplier is a small or medium sized enterprise and/or a
voluntary or community sector organisation and where it is, provide the
relevant registration number.”

 

 

The above section of your request would  exceed the appropriate limit
specified in the Freedom of Information and Data Protection (Appropriate
Limit and Fees) Regulations 2004. For the council, this limit is currently
set at £450. This represents the estimated cost of one person spending 18
hours in determining whether the council holds the information and then
locating, retrieving and extracting the information.

 

Section 12 of the Freedom of Information Act 2000 sets out that were the
council considers that the appropriate limit is likely to be exceeded it
is not obliged to respond to the request. As a result, we will not be
processing your request further as it is refused.

 

The Council does not centrally hold that information against each contract
and would need to carry out in excess of 18 hours to collate the
information and estimate that this would take around 200 hours to provide
a full and accurate response. However you may wish to conduct Google
searches for each individual Contract.

 

 

Most of the information that we provide in response to Freedom of
Information Act 2000 and Environmental Information Regulations 2004
requests will be subject to copyright protection.  In most cases the
copyright will be owned by Walsall Council. The copyright in respect of
other information may be owned by another person or organisation, as
indicated.

 

You are free to use any information supplied to you in response to this
request for your own non-commercial research or private study purposes.
The information may also be used for any other purpose allowed by a
limitation or exception in copyright law, such as news reporting.

I am writing to request an internal review of Walsall Metropolitan Borough Council's handling of my FOI request 'Up to date details of current contracts over £5,000'.

You confirmed that you did not hold the data I requested on contracts with suppliers worth over £5,000 and that it would cost too much to provide this data.

However, there is a legal requirement to publish this data, so this should be part of your current workload and not necessitate any further cost:
