Dear Aberdeen City Council,

Recently the incumbent Heads of Service at Aberdeen City Council were made to apply for new HOS posts.

Some were successful and some were not.

a. Of those who were unsuccessful in applying for new HOS posts, some have been retained or offered new jobs with the council (eg former Head of Performance Management and Quality Assurance, and the former Head of Service Design and Development)? How many former HOS post-holders have been so retained in either staff of contract positions?

b. What posts have such former HOSes been offered? Are these permanent, fixed term or contract posts? If not permanent how long is each for?

c. What is the salary scale for each post at (b) above?

d. What was the application process for each job at (b) above and where were the new posts advertised and for how long?

Dear Ms Hardy,

Thank you for your information request of 10 May 2010, made under the
Freedom of Information (Scotland) Act 2002 (FOISA). Aberdeen City
Council (ACC) has completed the necessary search for the information
requested, and the following information can be supplied:

a. Of those who were unsuccessful in applying for new HOS posts, some
have been retained or offered new jobs with the council (eg former Head
of Performance Management and Quality Assurance, and the former Head of
Service Design and Development)? How many former HOS post-holders have
been so retained in either staff of contract positions?
1 former Head of Service post holder has been retained

b. What posts have such former HOS been offered? Are these permanent,
fixed term or contract posts? If not permanent how long is each for?
Project Manager (Fixed Term) to 31/03/11
Not sure of the definition of staff or contract (this is perhaps a
contractor). I can confirm that in terms of the position above the
person is an employee of the Council and not via an agency or
contractor.

c. What is the salary scale for each post at (b) above?
£43,809 - £50,024 per annum

d. What was the application process for each job at (b) above and where
were the new posts advertised and for how long?
Fixed Term project post was offered in terms of the Council's
redeployment process. Post was not advertised.

For the avoidance of doubt, whilst the applicant makes reference to
more than 1 former head of service, there is only 1 employee who has
been offered and accepted redeployment at this stage.

Aberdeen City Council’s Complaints Procedure under the FOISA

An applicant who is dissatisfied with the way in which Aberdeen City
Council has dealt with his/her request for information under section
1(1) of the FOISA regime, may, by virtue of section 20 of the FOISA,
require Aberdeen City Council to review its actions and/or decisions in
relation to that request.

If you wish Aberdeen City Council to review its actions and/or
decisions with respect to your request for information, you should write
to the City Archivist, Resources Management, Aberdeen City Council, Old
Town House, Broad Street, Aberdeen, AB10 1AQ. The City Archivist will
arrange for your application for review to be considered by the Review
Panel. The Review Panel will write to you informing you of its decision
by not later than twenty working days after receipt of your request
requiring that a review be made. By virtue of section 21 of the FOISA,
the Review Panel will also provide you with a statement of its reasons
for arriving at the decision it has made.

Your request for review should reach Aberdeen City Council by no later
than 4 August 2010. Your request for review must be in writing (or in
another form which has some permanency and is capable of being used for
subsequent reference i.e. audio/video tape recording). You must state
your name and address for correspondence. You must also give details of
the information that you originally requested from Aberdeen City
Council, and must state the reasons why you are dissatisfied with the
way in which your application for information has been dealt with.

Your Right to Complain to the Scottish Information Commissioner

By virtue of Section 47 of the FOISA, a person who is dissatisfied with
a Notice issued by Aberdeen City Council under Section 21 of the FOISA,
may apply to the Scottish Information Commissioner, for a decision as to
whether, in any respect specified in that application, the request for
information under section 1(1) of the FOISA, has been dealt with by
Aberdeen City Council in accordance with Part 1 of the FOISA.

An application to the Scottish Information Commissioner must be made in
writing (or in another form having some permanency ie a video/tape
recording) within six months of receipt of a section 21 Notice by the
applicant. An applicant must state his/her name and address. An
applicant must also specify: -

- the request for information to which the requirement for review by
Aberdeen City Council relate;
- the matter which gives rise to the applicant’s dissatisfaction
pertaining to the applicants request for review;
- the matter which gives rise to the applicant’s dissatisfaction
pertaining to the decision given in the section 21 Notice.

In particular I understand that the former post-holder of Head of Service Performance Management and Quality Assurance is still employed by Aberdeen Council.

Please confirm in what position that employment now is, when that new job was established, what grade it is at, and what structural level (eg 2nd, 3rd or 4th tier).

Please provide a job description, person specification and Job Evaluation outcome for the post and confirmation of how that post was advertised for others to apply for it.

Please provide a copy of any letter of appointment (redacted to remove the personal details of the incumbent) and a copy of any emails, memos or letters between HR Service and employees in the Continuous Improvement Service as regards this post and the appointment to it.

Please also provide such information for any other Heads of Service who are still with the authority - eg Head of Service Culture and Learning.

Thank you for your information request of 2 June 2010, made under the
Freedom of Information (Scotland) Act 2002 (FOISA). Aberdeen City
Council (ACC) has completed the necessary search for the information
requested.

- Please confirm in what position that employment now is, when that new
job was established, what grade it is at, and what structural level (eg
2nd, 3rd or 4th tier).
The post was formally approved on 17/06/10 at Finance & Resources
Committee as part of the Corporate Governance restructure process.The
job is Performance, Audit & Risk Manager and is Grade 16 (3rd tier).

- Please provide a job description, person specification and Job
Evaluation outcome for the post and confirmation of how that post was
advertised for others to apply for it.
A copy of the job description, personal specification and Job
Evaluation information requested is attached.
The post was not advertised as only approved on 17 June. A former Head
of Service who was 'at risk' at that time and had relevant work
experience was redeployed into this post, initially on a fixed term
basis, pending approval at Committee. This appointment will now be made
permanent under the terms of the Council's Redeployment Policy.

- Please provide a copy of any letter of appointment (redacted to
remove the personal details of the incumbent) and a copy of any emails,
memos or letters between HR Service and employees in the Continuous
Improvement Service as regards this post and the appointment to it.
We are unable to provide you with information on letters of appointment
as it is exempt from disclosure. In order to comply with its obligations
under the terms of section 16 of the FOISA the Council must issue
official refusal notices in relation to any requests for which it is
claiming an exemption under the FOISA. I therefore attach a refusal
notice which specifically refuses your request under the terms of
Section 38(1)(b) - Personal Information of the Freedom of Information
(Scotland) Act 2002.

- Please also provide such information for any other Heads of Service
who are still with the authority - eg Head of Service Culture and
Learning.
As per previous response, there were a number of former Heads of
Service (previous structure) left, leaving or employed in new roles. A
list of the new Heads of Service can be found at:

In terms of the specific post of Head of Service Culture and Learning,
I can confirm that there were 3 in the former Neighbourhoods, 1 was
appointed to a post in new structure, 1 is currently seconded to an
external organisation and 1 is still employed pending the new Head of
Service commencing in August 2010 to allow a handover and the former
Head of Service will then leave our employment.
