Dear Grace
Thank you for your helpful response. Would it be possible to obtain copies of the 60 determinations mentioned (which I know are in the public domain) or do you feel that would be too much work for a FOI request?

Yours sincerely,

stephen hudson

Freedom of Information Requests, General Dental Council

Dear Mr Hudson,

Thank you for your request for copies of the 60 determinations mentioned. Your request was received on 30 April 2018 and has been allocated to the GDC’s Information governance team to provide a response. We are dealing with it under the terms of the Freedom of Information Act 2000 (‘the FOI Act’).

The GDC will process your request promptly, however, please note the FOI Act allows public authorities (the GDC) up to 20 working days to provide a response. To enable us to search our records to see whether we hold any information that falls within the scope of your request please can you clarify which 60 determinations you are referring too? To help clarify your request you may find it helpful to read our disclosure and publication policy which explains how long determinations are published for on our website, which I have enclosed a copy of. To assist, it may also be helpful to explain that section 12 of the FOI Act allows public authorities to refuse requests where it is estimated that it would exceed the appropriate the time limit (18 hours) to locate, extract and/or retrieve the information. For the purposes of time and cost calculations section 12 of the FOI Act provides that requests can be aggregated if they relate to the same or similar information and are received within 60 consecutive working days. You have sent in a second freedom of information request relating to determinations. If you also requested a copy of the determinations highlighted in the second response we would not be obliged to complete both requests

You may be aware that under section 10(6) of the Freedom of Information act authorities are not obliged to answer a request where they reasonably require further information in order to identify and locate the information requested and has informed the applicant of that requirement. The statutory deadline for us to respond to your request is being extended by the time it takes for you to provide the clarification we require.

Yours sincerely,

Grace Perry
