Unpublished DHSC Covid PPE Contract Documents value £74,502,300
Dear Department of Health and Social Care,
Sir Chris Wormald Permanent Secretary at Department of Health and Social Care wrote to the Public Accounts Committee on 2nd November 2021 and said:
“As of the end of June 2021, the Department [Department of Health and Social Care] is not aware of any Contract Award Notices (and the associated Contracts and Contracts Finder Notices) which have not been published in respect of contracts awarded for the supply of goods and services in response to the COVID-19 pandemic”.
Maria Caulfield MP Parliamentary Under-Secretary (Department of Health and Social Care) in a written answer on 19th June 2023 to a question from Daisy Cooper MP said "the Department has investigated and corrected a small number of cases where attachments [contract documents] that appeared to have been published were not visible on Contracts Finder.
However, there are no contract documents for the following five contract award notices published on Contracts Finder for PPE contracts awarded between 3rd April 2020 and 21st May 2020 to Tower Supplies, MYSHiPPER Ltd and Elite Creations worth in £74,502,300.

I would like you to provide me with copies of the missing contract documents for the contract award notices listed above and suggest you also take action to publish the missing contract documents on Contracts Finder as soon as possible in accordance with PPN 01/23: Requirements to publish on Contracts Finder and earlier PPNs that were in force when you awarded these contracts.

I am writing to request an internal review of the Department of Health and Social Care's handling of my FOI request 'Unpublished DHSC Covid PPE Contract Documents value £74,502,300' concerning the following two contracts where only the terms and conditions have been published on Contracts Finder:

PPN 01/23: Requirements to publish on Contracts Finder says:
"2. Publishing contract documentation at the award stage
In addition to the requirements to publish details of the award set out in section 5 of Part 1 of this
guidance, In-Scope Organisations should publish the awarded contract documents with the
awarded opportunity notice on Contracts Finder within 30 calendar days after the contract
award date.
Where departments have agreed to adopt this transparency policy with their sub-central NDPBs or
ALBs on a voluntary basis, these bodies should aim to publish the awarded contract documents
with the awarded opportunity notice on Contracts Finder within 90 calendar days after the
contract award date.
The awarded contract documents would include the signed contract and other associated
documents that may include:
●the specification;
●terms and conditions (T&Cs);
●any associated schedules (which may include the winning tenderer’s bid)."
The PPN does not exempt a purchase order, which is just another term for a contract, from being published on Contracts Finder and I would therefore like you to provide me with copies of the following for the two MySHIPPER LTD contracts either directly or by publishing on Contracts Finder:
The signed contract and other associated documents including:
●the specification;
●terms and conditions (T&Cs);
●any associated schedules (which may include the winning tenderer’s bid)
