Unlawfulness penalty
Dear The Regulator of Social Housing,
Please would you tell me what penalties for non-compliance other than a governance downgrade, were applied to Housing 21 for their failure to correctly implement Section 23 of the Welfare Reform & Work Act, 2016.

Your request was received on the 24 July 2020. We aim to respond to your request as soon as possible, and in any event, within 20 working days. You will therefore receive a response on or before 21 August 2020.
Please note that the contents of your recent enquiry and our forthcoming response are also subject to the Freedom of Information Act 2000/Environmental Information Regulations. The Regulator of Social Housing may be required to disclose your request and our response accordingly.
We wish to advise you that this is the third similar FOIA request we have received within the space of a month, relating to s.23 of the WRWA. In estimating whether the relevant cost limit, in accordance with s.12 of FOIA, has been exceeded the regulator can include the costs of complying with two or more requests so are long as the requests meet the following conditions:
•Requests made by one person, or by different persons who appear to the public authority to be acting in concert or in pursuance of a campaign;
•Requests made for the same or similar information;
•Requests received by the public authority within any period of 60 consecutive working days.
We believe the above conditions have been met in the case of the 3 FOI requests received and therefore we will be aggregating the time we have spent on complying with them in estimating whether the cost limit has been exceeded. Please note that the cost limit for the regulator is £450, which equates to 18 hours of work.
