Unlawful use of public authority time and equipment and inappropriate behaviour by employees

Dear North Wales Fire and Rescue Service,

It has come too my attention that members of your staff may be involved in the circulation of Islamophobic and racist material during working hours, i.e. during hours for which thy are paid to be in your employ as a member of a public service and local authority body, and utilising Fire Service computer equipment by which to do so. As per any large public body, I am sure you have your own intranet type set up and are thereby able to monitor staff use of such computer equipment. I would therefore seek the following information;

From the information stored on your computers and associated systems,can you tell me for how many hours/minutes North Wales Fire and Rescue service staff have been logged onto the web page related to a [redacted] publication entitled [redacted] and how much this costs the fire service in terms of the wages being paid whilst the staff member/members are carrying out this non fire service function.

From the information held on your IT computers,can you tell me for how many hours/minutes North Wales Fire and Rescue service have been logged onto the Facebook page related to a [redacted] Facebook page entitled [redacted] and how much this costs the fire service in terms of the wages being paid whilst the staff member/members are carrying out this non fire service function.

As records would be made on any relevant computers, could you provide me with documents that may have been stored, in English or [redacted], on your public authority computers that will have been/will be sent to the [redacted] publication.

Could you provide me with the policy documentation that pertains to a) misuse of the internet by your personnel, b) race and diversity within the service and how inappropriate behaviour is dealt with and c) the policy document on fire service personnel being employed elsewhere in addition to the fire service. I would also like the policy documents on your disciplinary procedure pertaining to suspension of staff under investigation.

Please provide any documents relating to the two above internet sites stored on any of your services computers.

Are contact details stored on any email accounts/desktops by any of your staff for other members of the two publications?

Further to your recent request made under the terms of the Freedom of
Information Act as detailed below, the response from North Wales Fire and
Rescue Service (NWFRS) is as follows:

 

1.      From the information stored on your computers and associated

The Service neither confirms nor denies that it holds information falling
within the description specified in your request. The duty in Section
1(1)(a) of the Freedom of Information Act 2000 does not apply, by virtue
of section 40(5) of that Act. This should not be taken as an indication
that the information you requested is or is not held by the Service.

 

2.      From the information held on your IT computers, can you tell me

The information relating to NWFRS’s policy on race and diversity is exempt
under Section 21 of the Freedom of Information Act, because the
information is accessible to you, as it is already in the public domain on

Discipline Handbook and Outside Employment Policy are attached.

NWFRS estimates that it will cost more than the ‘appropriate limit’ to
provide a response to your request. Section 12 of the Freedom of
Information Act makes provision for public authorities to refuse requests
for information where the cost of dealing with them would exceed the
appropriate limit, which for local government is set at £450. This
represents the estimated cost of one person spending 2.5 working days in
determining whether the department holds the information, locating,
retrieving and extracting the information.

 

Given the number of staff, their associated email accounts/desktops and
the capability of available tools, it is not possible to find, retrieve
and extract the requested information within the appropriate limit. Nor is
it possible to detail if the information is held, as to do so would
require compliance with the request, which would exceed the cost limit.
