Unlawful Consultation documents?

Scottish Parliament did not have the information requested.

Dear Scottish Parliament,

In a circumstance where the Scottish Government has provided false information in a Consultation document prior to a Bill going through the Scottish Parliament what is the formal, recorded process whereby a member of the public makes a formal complaint to the Scottish Parliament pertaining to that Consultation document?

• a routine first-time request for a service, for example, local services, transport, housing, health provision
• requests for compensation from external organisations
• things that are covered by a right of appeal, for example, planning and related appeal decisions
• Freedom of Information or Environmental Information request decisions
• legal proceedings or judgements
This list does not contain the recording of a formal complaint about the use of false information in a Consultation document prior to a Bill

Mr Henry, much concern has been raised regarding your serial annotations with a Freudian Fixation with a person or others whom you believe are the subject of your fixation which could be classed as psychotic and delusional.

This is symptomatic with Borderline personality disorder, it might be worth contacting your usual psychiatrist for a fresh evaluation of your mental health.

With No ill will vexation or malice, only concern about your erratic and disturbing behaviour.

Dear Scottish Parliament,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Scottish Parliament's handling of my FOI request 'Unlawful Consultation documents?'.

The Scottish Parliament are thanked for their response and the information that has been provided but an Internal Review is requested because a scenario does not seem to have been included within the response.

Could the Scottish Parliament please look back at their response and consider what would happen if incorrect information was provided in a Consultation Document (and that the Judiciary in Scotland could confirm that this information is incorrect e.g. from a Judgement in a prosecution) and the consultation was used to enact legislation that has passed royal assent.

If the route to redress concerns is still through the Scottish Government (rather than any Scottish Parliament committee) then this Internal Review should, hopefully, clarify this matter.
