Thank you for your Internal Review request dated 4 June 2018 in which you seek answers to the following:

“….If you could explain how a person could identifiable by you provide the specific years to which the claims started/finished and at which of your constituent colleges the actions occurred as it does not seem plausible that the students could be identified from the provision of this information”

I have reassessed your request and after consideration I have concluded that the university’s initial response in which we relied on section 40(2) of the FOIA to section f is correct. The withheld information constitutes the personal information of a third party and to disclose would contravene the data protection principles. We have to assume that responses to Freedom of Information requests will be in the public domain. If the information sought at section f was disclosed, given the small dataset of four cases, there is a likelihood that from the combination of information you seek and other information available to them, fellow students on the same cohort could identify the individuals. As such we do not consider disclosure of the personal data to be fair and in the circumstances within the reasonable expectations of the data subjects.

We hope we have explained the reason why we are unable to satisfy this element of your request. If you are not happy with the outcome of this internal review, you can contact the Information Commissioner (as an appeal under s. 50 FOIA) by writing to:

We write further to your request for information dated 30 November, in which you sought copies of the two non-disclosure agreements (NDA).

Under s.40(2) - personal data of a third party, the University may withhold information from you if the disclosure of the information would contravene any of the data protection principles set out in the Data Protection Act 2018 (“DPA"). The University considers that disclosing the NDA agreements to you would contravene the First Data Protection Principle (relating to fair and lawful processing) as well as undermining the purpose and nature of the NDA, which is to keep the claim confidential between the parties.

Individuals have not consented to the disclosure of their personal data. The disclosure of the agreements would not be fair to the students involved because it relates to personal details of their claim, which is intrusive and may have a detrimental impact on them in terms of their privacy being violated through the release of the agreement. In addition, these are private individuals that would not reasonably expect the details of their NDA agreement to be made public. As such under Section 17 of the FOIA we are issuing a refusal notice.
