I am writing to request information under the Freedom of Information (Scotland) Act 2002. I am asking for academic credentials of the following, including degrees, information on where and when they were awarded witn subject of relevant submitted theses or dissertations, and full text theses and dissertations or links to where they can be readily obtained online:

All members of:
1. The University Executive
2. The University Court
3. The University Senate

Any additional detailed information held by the University in relation to these individuals, and not otherwise published on the website or publicly available, would be considered personal data relating to identifiable individuals. To provide you with such information on members of Court, Senate and Executive would put the University in breach of the data protection principles in Article 5(1) of the GDPR. Hence the University is relying on Section 38(1)(b) together with 38(2)(a)(i) of the Freedom of Information (Scotland) Act 2002 to withhold this information.

Please also find attached a review notice setting out the steps you may take if you are not satisfied with the response provided to your request.

I refer to your request dated 14 September 2018 for an internal review of
the University’s response to your request under the Freedom of Information
(Scotland) Act 2002 dated 15 August 2018. In you review you have stated
that:

After having reviewed the response originally provided to you on 12
September 2018, I note the outcome of this review below.

 

In its response, the University advised that:

Any additional detailed information held by the University in relation to
these individuals, and not otherwise published on the website or publicly
available, would be considered personal data relating to identifiable
individuals. To provide you with such information on members of Court,
Senate and Executive would put the University in breach of the data
protection principles in Article 5(1) of the GDPR. Hence the University is
relying on Section 38(1)(b) together with 38(2)(a)(i) of the Freedom of

It is considered that the University’s original response was correct to
withhold additional personal information related to the qualifications of
Court members and individual members of staff, beyond that which has
already been published by the University or is publicly available
elsewhere. What the University has done is provided you with the names of
the Executive, Court and Senate members along with links to the University
web pages containing what information the University publishes about these
individuals. To supplement this information, I am also now providing links
to the University staff pages where biographical information about Senate
members can be found on individual school websites:

Information can also be found by entering a staff members name in the
search box on the University website.

 

In relation to the titles and copies of theses of the individuals listed
above, if you wish to determine the titles of theses or if full text
versions, or links to the full-text versions, of any thesis or
dissertation for any of the individuals identified in the University’s
response are available online through the British Library or some other
source, you are able to do this through the British Library website or
other publicly available sources.

 

In order to provide this information separately, the University would have
to ask all members of these groups to supply us with an extract from their
CV which included the requested details plus a copy of their thesis or
dissertation which may or may not be available electronically.  We would
then have to collate this information into a format with which to
respond.  Membership of Executive, Court and Senate (with those on more
than one group counted only once) amounts to 64 people.  In order for us
to contact each person, to ask them for a relevant extract and a link to,
or copy of, their dissertation, assuming the University holds this
information, and collate a response would take a minimum of one hour per
person = 64 hours. This would be undertaken by a  member of staff on a
grade exceeding £15 an hour (maximum chargeable hourly rate under the
Freedom of Information (Scotland) Act 2002).  The estimated total cost of
providing the information that you have requested is 64x£15 = £960.  In
addition, photocopying costs would apply for those theses which were not
available electronically.  As the estimated cost of providing the
requested information exceeds the cost prescribed in the regulations of
£600 the University is relying on Freedom of Information (Scotland) Act
2002 Section 12(1) Excessive cost of compliance together with paragraph
13(2) to withhold the requested information.

refer you to the attached document for further information on the options
available to you.

 

I trust that this response explains the University’s position on what
information is exempt from disclosure under the Act and what information
the University is able to provide you with in response to your request.
