Universal Credit - Self-employed claimants with losses brought forward from a business which has ended

Dear Department for Work and Pensions,

Official guidance for Universal Credit provided to the House of Commons library says that any unused losses cannot be carried forward to later Assessment Periods if "the self-employment business the loss relates to ends". See the third bullet point on page 3 here:

However, the Regulations (UC Regs, Reg 57-57A) do not seem to provide for such a limitation.

Please send me any document or information held by the Department which explains or provides the legislative backing for this rule.

Although the DWP have written that they do not hold the requested information, their response does clarify that losses can only not be carried forward where the claimant no longer has any self-employed income. This implies that the losses could be used against other self-employed income if and when any is earned.
