I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Universal Credit Programme - Post Reset Milestone Schedule'.

The DWP should have provided a response to this RFI by the 5th October, it has not. Please do not use this IRR as an excuse to delay disclosure any further.

The Information Commissioner is clear that a public authority must provide a substantive response (even if that is a refusal) within a maximum of 40 working days from the initial request. This time period also includes dealing with IRR. If the DWP does engage one of the qualified statutory exemptions please provide the public interest balance test it applied.

Therefore, if the DWP breaches the established timescales I will submit a complaint to the Information Commissioner.

Dear DWP Strategy Freedom of Information,

Thank you for your response notifying me that you are claiming extra time to carry out the public interest balance test ("PIT"). The DWP should be aware that it can only seek an extension to carry out the PIT and that the Information Commissioner states that no authority should take longer than 40 working days from receipt of a request for information to providing a substantive response (i.e. disclose the information or cite one of the statutory exemptions). The 40 working day period includes carrying out a PIT. Therefore, if the DWP fails to provide its substantive response within 40 working days I will complaint to the Commissioner.

It is extremely disappointing that the DWP has failed to meet its own target of 2nd November to respond to this request for information. I have allowed a significant additional time in the hope that the Department's response was only slightly delayed. However, I now have to conclude that it is abusing the IRR and public interest test stages of the FOIA to delay giving its final response.

The Department has therefore left me no other option than to complain to the ICO.

Thank you for your response IR 73 dated 31 March 2016. It is difficult to know how to react when the Department issues responses of this quality. The Department claims that "A reply to your original request is attached. " Nothing could be further from the truth. The attachment is PIT 3784 dated 12 October 2015 that was post on the WDTK site on 2 November 2015 (almost a month after it was written!).

The Department's handling of the RFI has fallen well short of what is required under the FOIA. If the Department does actually have a final response please provide it without further delay. I doubt the Information Commissioner will be impressed by the Department's handling of my RFI.

Despite the DWP being 6 months late in responding to this RFI I'm sure the Commissioner will expect me to give it the opportunity to carry out an IRR now that it has cited a statutory exemption.

At this point I see little point in explaining why the DWP engagement of s.36 is flawed as I have yet to see the DWP revise its initial decision when it has cited an exemption. Please complete the IRR as quickly as possible so that we can allow the Commissioner to complete his investigation and issue a decision notice.

Thank you for your response (IR123 and IR 193) dated 23 June 2016. Unfortunately this response relates to a different RFI called “Universal Credit Programme - Post Reset Milestone Schedule”, submitted on 7 September 2015.

I assume that this response was sent in error and that I can expect a response specific for this RFI very shortly?

If the DWP intends to rely on this response please confirm that is the case and I will notify the Commissioner that I have received the DWP final response in the matter, albeit outrageously late.

I would be grateful if someone could chase the extraordinarily late response that is due and explain why the DWP is consistently failing to comply with the timescales required under the FOIA.

The DWP has decided to appeal the Commissioner's DN to the First-Tier Tribunal. Given the age of the information (over 3 years) this does seem to be an inappropriate use of public funds.

It seems that the DWP has had a change of heart. It's Solicitor contacted the First-Tier Tribunal today to withdraw its appeal and state that it will disclose the requested information within 10 working days.
