Dear Department for Work and Pensions,

I have been mandated (forced on the threat of sanctions) to community work placements & have been assigned a provider.

1.) Will i be sanctioned if I do not sign the contract the provider expects me to sign?
.wouldn't such contract be void if signed under threat of such sanction (duress)?

2.) Will I be sanctioned if I do not sign my signature when entering the building for an appointment? Is it mandatory? Can I reject it without being sanctioned?

3.) Do I still have my right to privacy ect without risking a benefit sanction?
.has the provider been given powers by the secretary of state?

4.) Can i refuse to sign any contract with the (cwp) community work programme? Without the threat of being sanctioned or being sanctioned?

5.) I am aware of universal credit claims that are 'closed' as the claimant disputes the mandatory registration with universal jobmatch as a condition of claiming uc. The claims are closed by the work coach due to the 'day one conditionality' (also known as sr13 conditionality) which explicitly requires registration with universal jobmatch.

6.) Is it mandatory to sign up with universal job match a as a condition of universal credit?

7.) Will I be sanctioned if I refuse?

IN AUGUST 2016 A FIRST TIER TRIBUNAL JUDGE DETERMINED THAT UNIVERSAL JOBMATCH IS AN UNNECESSARY INTERFERENCE WITH MY ARTICLE 8 RIGHT TO PRIVACY.

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Universal Credit claims that are 'closed' as the claimant disputes the mandatory registration with Universal Jobmatch'.

IN YOUR SECOND PARAGRAPH YOU STATE:

In reference to questions 5 - 7. Day 1 Conditionality only applies to claimants in the
“all work related requirements” group – Intensive regime who are expected to create
an account with Universal Jobmatch and this will be included as a requirement in the
claimant commitment if a claimant has not already created an account. It is a
condition of entitlement to Universal Credit that a claimant accepts a claimant
commitment. If a claimant commitment is not accepted there can be no entitlement to
Universal Credit and a claim will be disallowed. There are some circumstances in
which a claimant will not be required to register with Universal Jobmatch including,
for example, if a claimant lacks literacy or numeracy skills or has no reasonable
access to their own computer/device and cannot access an alternative internet
access device in their area.

MORE IMPORTANTLY PART:

It is a
"condition of entitlement to Universal Credit that a claimant accepts a claimant
commitment. If a claimant commitment is not accepted there can be no entitlement to
Universal Credit and a claim will be disallowed"

HOW EVER IT ALSO STATES IN “Requiring Jobcentre Plus customers to use the Services

10.7 When the Services are implemented, Jobcentre Plus customers (including potential jobseekers) will not be mandated to register and create a profile…”

No, but if not, jobseeker’s will not be able to access all the facilities listed in
question 7.”

“Q13. Will claims to benefit be affected by the service?
No, this is a job posting and matching service, which is open to everyone, not just benefit claimants and is not connected to any claims.”
