Universal Credit - Childcare costs in respect of a period before an award is made
Dear Department for Work and Pensions,
Until 6 May 2022, the ADM as published on gov.uk (Chapter F7, Paras. F7062-F7063) explicitly stated that childcare costs paid by a claimant after they had made a claim for UC, but in respect of a period prior to the claim, could be included in the costs attributed to the AP in which the payment was made.
On 6 May 2022, the ADM was amended to state that childcare costs relating to a period prior to the claim cannot be included in an award of UC.
However, the legislation (Universal Credit Regulations 2013, Reg. 34A) seems to be clear that such costs CAN be included in the award.
Please can you provide any documents, information or correspondence held by the Department regarding the changes made to the ADM on 6 May 2022. This includes any information regarding the legislative backing for the changes made.
