Thank you for your Freedom of Information request, received by the College

Freedom of Information is dealt with in accordance with your ‘right to
know’ under section 1(1) of the Freedom of Information Act 2000
(FOIA(2000)), which entitles you to be advised in writing as to whether
the College holds the information you have provided and to be provided
with a copy of that information unless an appropriate exemption applies as
detailed in Part II of the Freedom of Information Act (2000), Section 12
or Section 14.  Should this be the case, the College will explain the
reasons for this application.

 

You have requested the following information:

 1. How many trade union reps are there working at the college?
 2. How much time do reps get for their union duties?
 3. How many full time union reps are there?
 4. Can you give me a copy of your handbook or any other documents you
have in relation to the duties performed by union reps?

 

The College has provided a response to your questions below.  The College
can confirm that it does hold the information you have requested to all
questions.  Please see responses below and Refusal Notice (if applicable).

 

 1. How many trade union reps are there working at the college?

 a. The College can confirm that we do hold this information.
 b. Under [1]Section 40(2) of the FOIA, we are not obliged to provide
information that is the personal information of another person if
releasing that information would contravene any of the Principles
of GDPR.  The number of Union staff reps is low therefore
rendering the data potentially identifiable.  The College is
maintaining this exemption as we consider the disclosure of this
identifiable information to be 'unfair', contravening the first
Principle of GDPR.

 

Personal Information

40 (2)        Any information to which a request for information relates
is also exempt information if

(a) it constitutes personal data which do not fall within subsection
(1), and

(b) either the first or the second condition below is satisfied.

GDPR – Article 5(1)a - Principle 1

“Personal data shall be processed lawfully, fairly and in a transparent
manner in relation to the data subject ('lawfulness, fairness and
transparency')

 

This is an absolute exemption requiring no further Public Interest Test to
balance the public interest in maintaining this exemption

 

 2. How much time do reps get for their union duties?

 a. The College can confirm that we do hold this information.
 b. 11 hours per week (total allocated)

 

 3. How many full time union reps are there?

 a. The College can confirm that we do hold this information.
 b. None

 

 4. Can you give me a copy of your handbook or any other documents you
have in relation to the duties performed by union reps?

 a. The College can confirm that we do hold this information.
 b. Please see attached.  This is also publicly available on the UCU
website.

Thank you for your request for a review received by the College on 23rd
October 2018.  Your review relates to the information released to you
regarding your Freedom of Information request dated 6th October 2018.

 

As per section 6.2 of the Colleges Freedom of Information SOP, I (Records
Manager), convened a panel of independent personnel to examine the initial
request/response.  I can confirm that neither panel member had any
involvement in the processing of your initial request.  The panel members
hold the following positions within the College.

o Head of Digital Media
o Head of Systems Development, Information Technology and Services

 

I met with the panel on Monday 19th November 2018 and provided the them
with a copy of the following:

o Your initial request (6th October 2018)
o SERC response (23^rd October 2018)
o Your request for review (23^rd October 2018)

 

Upon looking at the review, the reasons behind the initial exemption was
explained along with supporting guidance which is issued by the ICO, the
independent regulator whose role is to uphold information rights.  We also
studied extracts of the Freedom of Information Act (2000) ‘FOIA’.  Upon
review of your request we have concluded the following:

 

o How many trade union reps are there working at the college?
o The College had initially withheld this information due to the number
being low and potentially identifiable.  We have concluded that while
the number is low, there are no other identifying details to narrow
the possibility of direct identification or details in relation to
specific Unions they are affiliated with.  In addition, the Union reps
are in a position to represent public workers as opposed to their
Union Membership being less public.

The College can confirm that the number of Union Reps in the South Eastern
Regional College is 5.

If after internal appeal you remain dissatisfied with the College
response, you have a right under Section 50 of FOIA (2000) to apply to the
Information Commissioners Office (ICO) for a decision.  For information,
