Complaints to Magistrates for Council Tax (CT) Liability Orders.

Going as far back as is reasonable (eg 5 years), up to the most recent data available, Please could you provide me with a table of information under the following headings:-

1. Date Of hearing
2. Number of CT Accounts Listed on a Complaint
3. Total Court fee paid
4. length of hearing defended/undefended
5. Number of CT accounts Liability Order made against
6. Total costs awarded to Billing authority
7. Actual cost of preparing for and attending the hearing.

Below is a table that shows the date of hearing; the number of summonses
sent (based on our complaint list); court fee paid and costs awarded; and
number of LO’s obtained.

Length of hearing defended/undefended – this is not recorded so we are
unable to provide this information.

Actual costs – this is not calculated per run. I have attached our last
calculation that is shown to the court which shows that actual costs are
slightly higher than the costs requested from these customers.

P Porter left an annotation ()

"The Council Tax (Administration and Enforcement) Regulations 1992 state that a Liability Order shall be obtained in respect [of an amount equal to the aggregate of] the sum payable and a sum of an amount equal to the costs reasonably incurred by the applicant in obtaining the Order."

The above statement conflicts with this:

"The Council is keen to avoid additional burden to those tax payers who find themselves in financial difficulty but considers that the expense associated with recovery proceedings should be borne by those persons against whom it is necessary to take action."
