Unclaimed land

Land Registry did not have the information requested.

Dear Sir/Madam,

Please could you give me a list of unclaimed land/property that is available to claim under common law in Kent.

In addition, how does one go about claiming this land or property?

Yours faithfully,

Miss King

Sondh, Gurmale, Land Registry

Dear Miss King,

Thank you for your e-mail dated 2 July 2012 in which you asked for a list
of unclaimed land/property available to claim under common law in Kent and
how does one go about claiming this land or property.

I have considered your request in line with the Freedom of Information Act
(the Act) and can confirm that the Land Registry does not hold the
information falling within the description specified in your request.

Please note that Land Registry’s core business is to register ownership of
land in England and Wales and to record dealings with registered land once
it is registered. As we are responsible for maintaining the register to
registered land we do not hold details of any unregistered or unclaimed
land in Kent area. However, in order to assist you further with your
request in relation to registered land in England and Wales, I provide the
following link which will take you to Land Registry Public Guide 1 (select
public on top of the page and then select guides) that explains in detail
about the information we keep and how you can obtain it :-

www.landregistry.gov.uk.

In relation to your second question I guide you to Land Registry Practice
Guide 5 (1) Adverse possession of unregistered land (2) registered land
where a right to be registered was acquired before 13 October 2003. This
is mainly intended for conveyancers and solicitors to assist to process
transactions. This guide explains Land Registry’s approach to applications
based on adverse possession for (1) first registration of unregistered
land and (2) registration as proprietor of registered land where a
squatter was in adverse possession for the requisite limitation period so
as to have acquired a right to be registered as proprietor before 13
October 2003. It also explains the procedures for making such
applications, and the options available to those served with notice of
them.
