Ulster University Council Minutes request

We're waiting for W. Weir to read a recent response and update the status.

Dear Ulster University,

The University states that it is committed to the Nolan standards in public life, including those of accountability and openness. However it is notable that minutes of the University Council meetings have not been made public and available on the Ulster University website since the meeting of 19th October 2020, a gap of almost one year.

I would be grateful if you could forward me minutes of all Ulster University Council meetings held between 19th October 2020 and 1st September 2021

I am writing to request an internal review of Ulster University's handling of my FOI request 'Ulster University Council Minutes request'. This request has not been responded to within 20 working days and Ulster University Council Minutes have not been made public on the university website for an entire year.

This is not in accordance with the Nolan principles of accountability and openness in public life.

Thank you for your request seeking minutes of all Ulster University Council
meetings held between 19th October 2020 and 1st September 2021

 

While the requested information is now attached, you will note that a
number of sections have been redacted owing to the nature and scope of the
information contained therein. 

 

Under the terms of the Freedom of Information Act, this information is
being redacted in line with the following exemptions:

 

Section 36 – Prejudice to the effective conduct of public affairs

 

Section 36 (2) states that Information to which this section applies is
exempt information if, in the reasonable opinion of a qualified person,
disclosure of the information under this Act -

(b) would, or would be likely to, inhibit—

(i) the free and frank provision of advice, or

(ii) the free and frank exchange of views for the purposes of
deliberation, or

 

(c) would otherwise prejudice, or would be likely otherwise to prejudice,
the effective conduct of public affairs.

 

Section 43 – Commercial Interests

 

Section 43(2) states:

 

 2. Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of
any person (including the public authority holding it).
 3. The duty to confirm or deny does not arise if, or to the extent that,
compliance with section 1(1)(a) would, or would be likely to,
prejudice the interests mentioned in subsection (2).

 

Section 43(2) exempts information whose disclosure would, or would be
likely to, prejudice the commercial interests of any legal person (an
individual, a company, the public authority itself or any other legal
entity), while section 43(3) provides an exemption from the duty to
confirm or deny whether a public authority holds information, if doing so
would, or would be likely to, prejudice the interests protected by section
43(2).

may raise the matter under the University's internal review process for
FOI requests. Please submit written details of your appeal to Clare

receipt.
