UK/Ireland: Convention on Social Security

Dear Department for Work and Pensions,

I am writing on behalf of the EU Rights and Brexit Hub about UK/Ireland: Convention on Social Security [CS Ireland No.1/2019].

In the DWP’s ‘Guidance relating to the UK’s operational implementation of the social security coordination provisions of Part 2 of the EU Withdrawal Agreement: Citizens’ Rights’ published on 11 November 2020 (https://assets.publishing.service.gov.uk...), it is stated that SI 2019 No.622 The Social Security (Ireland) Order 2019 brought the Convention into force (see page 9, footnote 1). However, Art. 65 of the Convention requires that the UK and Ireland ‘notify each other in writing when the necessary internal procedures for entry into force have been completed’ and that the ‘Convention shall enter into force on the date of the later of such notifications.’

With this in mind, please could you, within the limits of the FOIA, provide answers to the following questions, as far as possible:

1. Is the UK/Ireland: Convention on Social Security [CS Ireland No.1/2019] currently in force?

2. Has the UK sent notification to Ireland as required by Art 65 of the convention? What date was this sent and could we see a copy of this notification?

3. Has the UK received notification from Ireland as required by Art 65 of the convention? What date was this received and could we see a copy of this notification?
