UKBA Processing FLR(M) applications out of date received order

Waiting for an internal review by UK Border Agency of their handling of this request.

Dear UK Border Agency,

In an attempt to gauge the visa processing of postal FLR(M) applications, I monitor an online immigration forum at www.immigrationboards.com. Over and over we are told by UKBA processes visas based on date received/date biometrics taken and that only under special compassionate grounds do they process visas out of order.

Despite the insistence of this policy, we know this not to be true. According to more than one worker at UKBA that we have spoken to, our April 2012 application has not even been given to a caseworker. Instead, there have been numerous applications processed in June and July that have no special considerations or compassionate justification.

I've included at the close of the correspondence, several recent July applicant decisions posts as a sampling. Here are my questions:

1. Why is the UKBA deliberately providing inaccurate information to Q2 applicants regarding the prioritizing of applications by date received? Ours is a simple conversion of fiance visa to FLR(M) Leave to Remain that has not even been considered by a caseworker. You can't possible say that it is do to the complexity. We are not alone in this regard.

2. Why are June-July applicants receiving priority processing over Q2 (Mar-May 2012) applicants?

3. What is the UKBA doing to rectify the Mar-May backlog of applications? Responses by UKBA to the Home Affairs Select Committee re the working of UKBA do not align with the actual processing numbers provided through the FOI.

4. How many exact FLR(M) applications submitted by post are outstanding for Feb, Mar, Apr, and May 2012?

5. What are the average days processed by their respective month and quantity process/outstanding for FLR(M) applications submitted by post are outstanding for Feb, Mar, Apr, and May 2012?

6. Did UKBA lose application relevant data during a supposed system failure in May 2012 for applications received during Feb - May 2012?

7. Will UKBA continue the practice of processing applications out of date received order? If so, for how long and why?

We are compiling as many relevant documents on this subject to send to the House Affairs Select Committee. Your accuracy and promptness is appreciated.

UKBA received my application on 27th March. Then they sent biometrics letter after a week. After I did biometrics on 10th April, I heard nothing. I've been calling every week after my application reached its 6th month and it has always been PENDING DECISION status.

Applied on 11th May 2012, submitted biometric on 6th June 2012 and still awaiting. My wife is ringing them every day and the answer they give is "Your application is incomplete you've to keep waiting until some one contacts you". We logged a complaint and haven't received any reply so far, they failed again in service standards. Don't know how long we have to wait. It is really frustrating.

It's 4th Dec 2012 - 8+ Months since our application and NO UPDATES from UKBA yet.

Have been calling up for an update and after a 30-60 minutes wait on phone all they reply is that the applications are processed in the order they are received. No further information. What a waste of time and money.

My wife is inconsolable these days as she is waiting to leave the country due to a family emergency but she can't due to undue delays caused by UKBA in processing our application.

Have called UKBA many times and the only response they can give is the "application is pending".
Sent an email of complaint to UKBACustomerComplaints@homeoffice.gsi.gov.uk advising they are past the service standards published on their website 04/12/12.
Received an email from UKBA confirming they have accepted my complaint and will investigate the matter 10/12/12.
UKBA finally returns my documents and passport after 8+ month long wait! 14/12/12.
Currently awaiting my Biometric Residence Permit 17/12/12.

Applied FLR(M) on 28th March 2012 for my Wife and Daughter. Both on Fiance Visa.

Biometrics for Wife done on 21st April 2012.
Biometrics for Daughter done on 8th May 2012. Delayed due the Post Office scanner unable to read the barcode on the letter sent by UKBA.

8+ Months since our application. No updates from UKBA until 13th Dec 2012.

After countless complaints and getting the local MP involved. Thanks to our local MP. We received update from UKBA on 15th Dec 2012.

UKBA update = They have processed our application but LOST my wife's passport. Expecting Biometrics cards today and need to apply for duplicate passport for my wife.

No wonder they were not processing our application or replying to us. How do you process an application for which you have already lost the passport of?

Most irresponsible and unprofessional goverment agency we have ever come across. Total waste of time and money.

I've now requested three requests for information from UKBA spanning three months. To date, I've not received a response other than receipt acknowledgements or notice of delayed response. Two of my requests are now overdue:

Hi All,

I will be posting my annotation tomorrow when I have double checked all of my dates and letters. I too have applied for an FLR(M) extension, and have been waiting more than 4 months.

In the meantime, I have a question and I am wondering if any of you may know the answer:
I have obtained a concurrent passport from the Australian Embassy in order to travel home urgently for compassionate reasons. I will be away for 2 weeks, travelling on my new passport.
Am I going to have trouble getting back into the country on my return? Anyone had any similar experiences?

I have found a group who are monitoring applications and you can update your details to allow all to be updated and follow progress of apps.
The group shows clearly that applications are not being done in order.
Some biometrics enrolled in September have received their passports back already.

Postal application made for FLR(M) for my wife on 28th July 2012.
Acknowledgement letter received 6th August 2012.
Complaint made via UKBA website re. processing times and lack of information on 25th October.
Biometric data given on 26th November.
Reply from UKBA re. October 25th complaint received over two months after complaint - saying that they were still "considering applications where biometric data were given in April..."
We have now been waiting for five and a half months - no sign of my wife's passport or visa (or my UK passport for that matter!)

So far I've submitted four requests for information of UKBA over the past three months. Of the four, only one was satisfactorily answered. Two requests await internal review. The first was sent on 25 October 2012 (FOI Reference: 1815/24759). The second on 19 November 2012 (FOI Reference: 1909/25187). These two requests have far exceeded the standard response time as well as the internal review.

I have made a FLR(m)application back in july 20th 2012.
I have received the acknowledgement letter on the 31 July and request for biometric back in September 2012.

Since then no more correspondence.
so waiting for near enough 7 months.
called few times but no reasonable answers.
Contacted local MP(member of the parliament) but not helpful.

hi goodmorning,please can anyone be of help in advicing me on what to do or who to write to,i summited by flr m application on 29 june 2012,got acknowledgement letter on 10th july,biometric invitation on 9 october and did the biometric on 15 october,my dad was hospitalised for prostatic cancer on 17 december,i sent his medical report to UKBA through my mp and solicitor on 11th of january and upto date i have not heard from ukba,the pain of my dad health is killing me slowly cos i cant be able to see him which he has requested for,i have lived with my wife nearly 2yrs now,please what should i do,who can give me solution on how to go about it,i called their line and the person that picked my call said it is awaiting decision on decision table,next time i called another person said it is better i withdrew my application if it is urgent,it is more than 7months and 2weeks and 1 day,please are this ukba have conscience,it is better for the teams or case workers to come out of their office and go to addresses which i have giving them to make enquiring about the marriage than keeping my application in a cooler in the name of investigation,my whole neighbourhood knew us .Kings

After 10.5 months of waiting, all my documents and passports have arrived. Still have to wait for the BRP card in 7 days. I'm still gonna complain to the ombudsman about this though.

Hello its such a pity whereby they are very fast in taking the money. My brother is getting married i keep on calling the UKBA hotline number 0870 606 7766 unfortunately they keep on telling 6 months waiting period. Am the only sister and i come from a very small village in Kenya my village is called Nyeri and on the biometrics letter they say only if its an expedited case its a matter of a life and detah situation then they maybe able to give a levy, correct me if i have worded it wrongly. I have a grandma whom i havent seen for nearly 10 years and she is in Kenya. Am the only grand daughter what a pity i cant go for my one and only brothers wedding.
They are many applicants out their who maybe in my situation.

We sent out our FLR(M) application just before Christmas... We've now been informed of the UKBA's decision, and had all our documents returned to our solicitor (including my partner's biometric residence permit). I'm happy we received our decision so quickly, but it's unfotunate that it was at the expense of others.

I’m currently holding a tier 4 visa now graduated BA degree in UK (Thai Passport holder) My Tier 4 visa will be expired on October 2014, but because I have transferred my associated degree credits when I studied in US, I’d be able to have my first year in UK University exempted. I’m now graduated which left me one year of validity to stay in UK.
Couple weeks ago, I have received a letter from school basically notifies that I have to leave the country within 60 days after graduation due to completion the course earlier than expected. Since I am now having 18 months of same sex relationship with British citizen, I have been living with him only in the past 12 months without sharing any joint bills-account but the same address. Am I eligible to apply for unmarried partnership (FLR-M) without having to go back to apply from my home country?
So far, I have my proof of “our “address which includes:
- Letters from school
- My certificate of graduation- with the address
- Mobile Phone bills
- Bank Statement
- My P60
- Pay slip in the past 18 months of working in UK
- Letter from National Insurance, Job Centre

Quick question. What is current processing time for SET LR, straight forward case? I posted mine in August and the Biometrics has been done 3 weeks after. Can anyone please respond. Many thanks
