UC Health Checks and Project Assessment Review Reports

Response to this request is long overdue. By law, under all circumstances, Department for Work and Pensions should have responded by now (details). You can complain by requesting an internal review.

Dear Department for Work and Pensions,

In respect of the Universal Credit programme please disclose the following documents created by the Infrastructure and Projects Authority / Major Projects Authority (“IPA”):

RFI1:
- Health check April 2015
(Disclosed to the Work & Pensions select committee)

- Health check September 2016
(Disclosed to the Work & Pensions select committee)

- Project Assessment Review Report (“PAR”) March 2017
(Disclosed to the Work & Pensions select committee)

- Health check September 2017
(Disclosed to the Work & Pensions select committee)

Please note that the dates given for the documents above are my estimates based on non-DWP publications. The months may be incorrect from the DWP perspective. For example, if the DWP considers the date of a document I have stated as being September to be August or October it should treat it as falling within the scope of my request.

Given the age of the documents, I trust that the DWP will live up to its claims of being committed to transparency in line with the commitment to Open Government and disclose them without delay?

RFI2:
- Other PARs and Health Checks, not listed above, that were completed by the IPA during the period 01 April 2017 to 31 March 2019

Yours faithfully,

John Slater

Dear DWP freedom-of-information-requests,

Please disregard my previous RFI2 and replace it with the one shown below. This is because the period 01 January 2016 to 06 September 2018 is covered by an older request (dated 06 September 2018) that the Information Commissioner has not managed to issue her decision notice for.

RFI2:
- Other PARs and Health Checks, not listed above, that were completed by the IPA during the period 07 September 2018 to 31 March 2019.

My apologies for the confusion.

Yours sincerely,

John Slater

Policy Group FOI

Dear [email address] on behalf of DWP Central FOI Team,

Thank you for your reply relying on s.10(3) FOIA.

Having been here several times before I think it appropriate to remind the Department that the Commissioner states any final decision (including any extension to consider the public interest) must be issued within 40 working days from the date of the original request.

If the Department exceeds the 40 days limit I will complain to the Commissioner.

Yours sincerely,

John Slater

Dear John Slater,

I am writing in response to your request for information, received 28th
October.

Yours sincerely,

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions' handling of my FOI request 'UC Health Checks and Project Assessment Review Reports'.

Thank you for your response and the disclosed information.

I note the Department’s reliance on section 22 to refuse the remainder of my request. Unfortunately, the Department’s own response is proof that it is unable to rely on section 22 to refuse disclosure, as it clearly doesn’t not have a settled intention to publish the requested information.

The Department has also failed to comply with its obligations under section 1(a) FOIA in respect of my RFI2. This covers:
“- Other PARs and Health Checks, not listed above, that were completed by the IPA during the period 01 April 2017 to 31 March 2019”.

The Department is required to confirm the information it holds that falls within the scope of my request. This means it must tell me what PARs and health checks exist that fall within the specified timeframe. It cannot simply say that it is refusing to disclose information without telling me what it is actually refusing to release. This prejudices my ability to challenge the Departments reliance on section 22 and must therefore be considered unlawful.

I note the Department’s attempt at a public interest test. Unfortunately, as is so often the case, it fails the test set out in the binding case of Department of Health v ICO & Lewis [2015] UKUT 159 (AAC).

This states disclosure under FOIA should be approached on a contents, specific information, basis and not a class basis ([19]-[21]).A contents based assessment must show that the actual information is an example of the type of information within the class description of an exemption and why the manner in which disclosure of its contents will cause or give rise to risk of actual harm to the public interest, and evidence which does not address this is flawed ([29]-[30]).

The Department’s response is clearly a class-based response. This is supported by its attempt to impose a 3 year moratorium on disclosure. It would hard to construct something that demonstrates a class-based approach than yet another blanket ruling imposed by the Department.

I look forward to receiving the Department’s response to this IRR without undue delay.

Dear [email address] on behalf of DWP Strategy Freedom of Information,

The Information Commissioner issued her DN (case reference: IC-46647-Y7R2) today. She found that the DWP cannot rely on sections 22, 35 or 36 to refuse disclosure. I would be grateful if the DWP disclose the remaining requested information without further delay. Given the age of the requested information it is not in the public interest for the DWP to appeal the DN to the FTT.

Yours sincerely,

John Slater

Dear Department for Work and Pensions,

The Information Commissioner issued her DN (case reference: IC-46647-Y7R2) today. She found that the DWP cannot rely on sections 22, 35 or 36 to refuse disclosure. I would be grateful if the DWP disclose the remaining requested information without further delay. Given the age of the requested information it is not in the public interest for the DWP to appeal the DN to the FTT.

Yours faithfully,

John Slater

The Commissioner issued her decision notice (IC-46647-Y7R2) stating that the DWP cannot rely on sections 22, 35 & 36 to refuse disclosure.

Now waiting to see if the DWP appeals the DN. If it acts true to form it will appeal to the FTT.
